I thought Ryan made the point that using the term "Illithid" as a name
for a "tentacle-headed humanoid" was potentially a violation of
character copyright. If you  include the visual representation from the
MM or the description details from the MM or Illithiad you'd definitely
be treading on thin ice.

If you want to come up with a "tentacle-headed humanoid" that has
different stats that the Mind Flayer and has a different physical
description, a different picture, and a different society, I don't think
anyone is going to argue that you have violated a WoTC copyright. If
your intent is to duplicate the Mind Flayer as WoTC has imagined it,
well, hope you have a good lawyer.
