Shrug. So it appears. I may have been wrong in this case.

I tend to overreact to claims of works being in the public domain, since 
a lot of netizens have some seriously wrong notions of public domain, 
i.e, "Anything on the net is public domain" or "Anything out of print is 
public domain" and the like. Given the recent gross expansions of 
copyright and trademark, less and less material is public domain, to the 
point where the concept might as well not exist.

But, as I noted elsewhere, the main issue is trademark...
