I know that is Ryan's position but I am not sure I
would go that far for a number of reasons. 

1. Mind flayers are generic, not specific individual
characters
2. Also, I think most of the description is implied by
the SRD description--no move rate other than standard
humanoid rate (ie, no fly, climb, etc) implies biped,
listed as having high int, mental powers, four
tentacles around mouth. You come up with a humanoid
with an octopus head I just dont see the originality.
HR Geiger anyone?

I'm not saying WotC wont feel it is original and try
to enforce that. But I think Mind Flayer is a bad
example. But that is my opinion. It is not legal
advice.
