The concept of rolling multiple dice and dropping specific dice has been
around for a while, and I was even considering using something like it a
few years ago before D&D3e and d20.

So long as you wrote your text so that it didn't derive off of material
from the d20 SRD, I believe you can keep your particular expression of
the rules protected, and outside the OGL.  It won't stop someone else
from using the idea of roll 3 d20's and keep the middle result.

Maybe in theory, but hasn't been in practice.  Didn't Chaosium release a
d20 version of one of their games/settings (not sure which one), under
the OGL, while at the same time, keeping the demon summoning rules
(derived from their own copyrighted material) closed ?
