The concept of rolling multiple dice and dropping specific dice has been around for a while, and I was even considering using something like it a few years ago before D&D3e and d20. So long as you wrote your text so that it didn't derive off of material from the d20 SRD, I believe you can keep your particular expression of the rules protected, and outside the OGL.
