I dont see them the same at all. Chaosium has to
protect its rival, preexisting system. Mongoose knows
full well how to do things right and decided to do it
how they did it.

Correct how? I dont think the product did well so I
dont see them having much market incentive to worry
about it. This is a small market with companies with
limited manpower and time. They have zero incentive to
revisit the issue now, particularly since there are
possible legal ramifications for thier original
system.
