it's very simple. Non-d20 producers have created their own, unique IP from the ground up. They owe nothing to anyone else. d20 producers owe a great debt, their very existence usually, to the people who have made it possible for them to publish d20 material. In return those people have simply asked that those publishers give back a little to others.
