If Chaosim wants to have their own unique _rules_, they can use a non-OGL system.
If they want to have a _d20_ version of their game, and keep their _IP_ closed--well, then they're in the same boat as the rest of us, and should be treated as such.
Elric could have scooped WotC on high-level rules--but, (and I'm going on dim memory of a casual glance a year ago) , since they didn't open up their additions to the system, no one who wanted the rules bothered to pick up their system and propagate it.
But that said he has certainlyEach product should be treated differently--and the OGL really should be amended to require reasonable effort to check for updates.
