Agreed, but some people don't understand this.  When I pirate a 20+ 
year old game to try it out, people sometimes tell me that I'm 
short-changing the author -- what, like buying a 2nd-hand copy on ebay 
gives the author money?
	Very true.  After awhile it gets to be amusing to see people on *both* 
sides using the same argument to buttress their position.

	Most of the piracy arguments have practically fossilized.  It's like 
watching a ritualized exchange with the vast bulk of the arguments 
falling into a few groupings.

No, not legal at all, so if you want to decline on that basis I completely 
understand.  I'm just gathering up files for a game music streaming radio 
station I'd like to run someday (plus I'd like to hear the music on the disc -- 
I wonder if they remastered it in any way, or if it's just MT-32 output from 
the games themselves).  MP3 is totally fine (I prefer lame --preset standard 
or other similar VBR, but CBR 192K or higher is okay).  If you're willing to do 
 this, email me for FTP site upload to make it easy for you.

Because it wouldn't be any more legal that way (I have no explicit permission 
from Origin to stream the music).  In all honesty, I just want to hear it.  I 
have no intention of collecting it.  I'm not a fan of the music per se, I just 
want to hear how it turned out.

I can see a morality issue coming, so I'm going to head it off:  For older 
games that you are curious about, do you download a copy to try, or do you 
spend $150 or more to collect a copy you can open and play?  For example, I 
have never played Starcross and would like to give it a try.  Should I spend 
crazy amounts of money for a Starcross collectable, knowing that any money I 
spend will never get back to the people who made it (and the collectable itself 
will go down in value when I open it to get at the disk), or should I just 
download a copy and try it out?  Hopefully you agree the latter is the more 
practical choice.

Before anyone accuses me of being a pirate, I own 600+ new and collectable 
games.  I also own 100+ music CDs and 100+ DVDs.  I do buy things, you know :-) 
I just don't feel I need to collect something just to give it a shot.

I confess I'm unfamiliar with the mechanics of streaming, but do you really need EA's permission to do so? (Origin no longer exists even in UO server-farm form.) Wouldn't this considered a "permitted use" of the media? 

Outwardly, at least, it seems no different than playing a song on the radio. I played hundreds back in my DJ years and I'm sure I didn't have (or need) anyone's permission to play any of 'em. Or have the ground rules changed since the '70s and '80s?

Just because the founding copyright holder no longer exists doesn't mean that 
*somebody* doesn't own the copyright.  In fact, I think it's obvious that 
Electronic Arts owns all of Origin's Ultima and Wing Commander intellectual 
properties.  I'm sure that if I wrote a Wing Commander-like game, with WC 
properties (Kilrathi, Tiger's Claw, etc.) and used the string Wing 
Commander somewhere in the title, that I would get sued even if I wasn't 
selling the thing.

It's only covered under Fair Use if you make a backup copy for *yourself*.  If 
you give that copy to a friend, then you'd have to make a really strong 
argument that the copy was off-site storage for disaster recovery or else it 
doesn't hold up.

hobbyists will agree with me that current/former software pirates know the most

I hate to tell you this, but fair use does *not* cover making a copy
of a tape for a friend.  That's (technically) illegal.  Fair use
covers things like making a tape from a CD.  As long as you keep the
CD, you can play the tape for your own personal use.  At least this is
the case is the United States.

I didn't say no one held the copyright. I just meant the Origin's no longerin the game and that thepermission issue would rest with EA. 

But I do think it's worthexploring the "fair use" question and, failing that,whether there's an Internet equivalent of the RIAA (which someone else mentioned) that could address issues relating to Internet radio broadcast of CDs. Perhaps it's a simple affair.

Nothing is in place currently, however the RIAA prosecutes anyone found 
streaming video it did not pay them a license for.  So I don't think I'll have 
a problem streaming video/computer game music.

	I just want to point out you used a couple of bad examples.  ;-)  You 
can get a legal, playable copy of Starcross very cheaply.  As little as 
$5, even.  If you want to play a particular _release_ of Starcross (too 
experience the original bugs, I guess) you can grab the diffs and patch 
your existing legit version to whichever release you heart desires.

	Also, in the US, the First Sale Doctrine establishes that once you 
sell something (as the maker) that's all the money you're going to get. 
 A maker has no right to get more money on the sale of used items.  
That's like saying it would be wrong to buy a used or out of print book 
because the author wouldn't get any money.

I don't know if you could.  It wasn't created by a music publisher that 
the RIAA or any of the fee-collection agencies have an agreement with, 
was it?  Put another way, I make a music CD on my own, and I sell it in 
a few local stores.  A DJ from a local radio station (say its owned by 
Clearwater Communications, they own what, 33% of all the radio stations 
in America or some ridiculous number) buys it any plays it on the air.  
I never made an agreement with anyone negotiating how much I'd ask for 
for playing my music.  Does everyone get the same flat fee and 
magically a check just appears in my mailbox with *no* agreement 
whatsoever and that's the end of that, all legal and tidy?  That 
doesn't sound right, but I know just about nothing about this process.

PS - If I did make a music CD and a large radio station did play it, I 
probably wouldn't complain too loudly.  Their listeners on the other 
hand, that's another story...

I believe that this is as illegal as copying *ANY* music file.

Why doesn't Jim just bid on it, and then he can do what he wants with the music?

don't work in a comedy club, but my brother used to do stand up...does that 
count? : )

The 
Clouseau movies are great. I don't think they ever made a game based onthe 
series(although there are 2 Pink Panther adventure games based on the 
newer version of the cartoon), but they just released the Pink Panther 
collection on DVD. Unfortunately, It's missing one of the movies which was 
produced by another studio (although this can be bought separately), and is 
seriously lacking in special features.

BTW, 
Josh Mandel, one of my favorite adventure game designers and writers, used to do 
stand up,IIRC. : )

He has a few interesting items. Anyone who
needs a small box (GTI) Ultima WoA2: Martian Dreams just watch his auction
list. Hes posted quite a few of them, all shrinkwrapped. I got one from
him and it was in great shape minus some minor corner damage (a result of the very
cheap cardboard GTI used). Overall good service and great packaging, but way
overpriced for SH.
