I believe the question was "why not"?

Personally, I am quite unhappy about having to shell out more money just to upgrade my 
kernel (a small kernel upgrade fee, tho, would be acceptable).

Netraverse would seem to be guilty of "pulling a Microsoft" in the worst way.
