I am not going to get defensive; the thinking here was that an absentee ballot would create a paper trail. It does, but it's irrelevant because there is very strong feeling against election litigation, and the non-existent paper trail in other states makes the issue moot.
But the point is not why not enough was done sooner; it is what (if anything) can be done now. My own thought was that if Kerry was elected we would not have to worry about the Constitution. Though I am sure that was a rhetorical question.
