I guess you aren't aware of all of the complaints OpenSRS files with
ICANN. TUCOWS/OpenSRS is a driving force in trying to get ICANN to
correct problems and get off their butt.
In the case you describe, there is unfortunately no violation occurring
due to the way ICANN and NSI wrote the agreement.
