Just because a modem is 56k does not mean you will ever get that speed.  
The fastest I have ever seen is 53k but sometime it is also the maximum 
possible speed of the dialup number that limits the connection speed.  

I have one customer who cannot connect to greater than 32k with 
Earthlink's local numbers.  Try using a different local number, if one 
exists, and see if the connection speed differs.
