Then you're not the average consumer. Given decades of exposure to McDonald's marketing, the average person is going to associate a food item with the prefix Mc- with McDonalds: McRib, McPizza, McGriddle, etc. McSushi was obviously trying to establish itself in consumers' minds as the "McDonald's of sushi."


McDonald's is an institution. The slang term "McJob" appears in major dictionaries. The American Heritage Dictionary describes the word's origin as "Mc(Donald's), trademark of a fast-food restaurant chain (from its mass-produced nature) + job."

It's the same principle at work in court rulings that outlawed registering "BritneySpeers.com" or "Madona.com" as pointers to porn sites. It's unlawful to trade off someone else's well-known name and reputation.

Don't pretend to know more about the legalese of the contract then the lawyers who actually have access to it.

You do not know what the provision was or what the wording is. At best you are relying either on the statements of informed journalist who are GUESSING, or someone within Apple Corps who is violating the confidentiality agreement and leaking their slant on the agreement.

If it makes you feel any better, insert the word "reportedly" or the phrase "according to published accounts" at the beginning of each of my statements on the topic. This is a discussion list which by its very nature deals with a lot of speculation. Using your logic, no one here should be discussing this topic at all. (And by definition, an "informed journalist" isn't guessing.)


The fact remains that *according to published accounts* Apple has *reportedly* paid nearly $30 million USD in settlements to Apple Records for violation of these agreements. It's my guess that they feel they'll profit enough in the long run to justify the expenditure.

This is not a topic I care passionately about at all. Anyone who's keen to continue back-and-forth borderline personal attacks should just write me directly and not bother copying the list. The list is a public forum to discuss Macs, not Big Macs.
