I don't think that consumers being confused is a valid excuse.  Customers are confused 
all the time, despite obvious details that they simply overlook.  For example, I can't 
tell you how many times I've been in the drive through at some place, and the person 
in front of me simply couldn't understand the pricing, or the product that was listed 
right in front of them with illustrations no less.  As far as the name in a different 
industry thing, usually that's the case, but not always.  Ive been to several 
restaraunts with nearly identical names that are otherwise unaffiliated.
Saying that someone would name a place "Mcsushi" to try to make a business that 
reflects a fast food philosophy is probable.  Saying that it's an attempt to confuse 
consumers into thinking that they're going to someplace that is part of the McDonald's 
chain is paranoid, and petty.  Ooh, many "p" words in that sentence.
Also, asking a computer company- even back then- to produce computers that don't 
support sound limits it's growth and if they had stuck with such a limited mentality 
Apple Computer wouldn't be here today.  Likewise with an aggreement to not enter in 
selling or dealing with music in any way shape or form.  Above all, Apple Computer is 
about selling and marketing.  Apple Corps ltd is worried about Apple treading on it's 
recording industry ground, and selling individual songs or even CDs on a retail basis 
(not recording it, or producing it, or any of that) doesn't mess with Apple Corps ltd. 
 The most important thing in our "judicial" system is rights- protection and proper 
use of them.  How does anything that Apple Computer Inc do infringe upon the rights of 
Apple Corps ltd.?  I fail to see how they do.  Legality, in my mind, plays a minor 
role in all of this- even though it will determine solely what happens in court.  What 
I mean is, I could care less about what the court says, I'm concerned with the 
principles and ethics of the situation, regardless of what minor, petty details the 
legal system enjoys to play with.
