All this discussion of "confusion of brand identity" is a little off the mark. Copyright and trademark owners aren't necessarily concerned over consumer confusion. It's simply a matter of ownership of a uniquely identifying mark (name, logo, jingle, whatever). Some here might recall when the "Colonel" sold ownership of KFC (to the Pepsi company, I believe - Burger King, Pizza Hut, etc.), he also lost the rights to use his own likeness. In other words, he couldn't endorse other products because his appearance was "owned" by the new owners of KFC. (I think he's dead now). Furthermore, as someone has already pointed out here, if a company doesn't assert it's ownership rights consistently and over time, they could lose their trademarked name. This is why you hear absurd ad-speak phrases such as "Kleenex brand facial tissues" so often on various media spots. Everyone knows what Kleenex are, but if they just say "Kleenex", then over time it becomes equivalent to the common term and they lose the "capital K" so to speak. To me it appears to be a clear case of the Beatles (attorneys) attempting to assert their legal rights and nothing more.
