Thanks for the links and information clearly much different from state to
state and this is the only incident that I have ever had with any GS and I
didn't dishonor it I only made a stipulation in order to use it at half off due
to the expiration date.

That's because my first link and the link that you posted, Deb, are from sites
that are compiling the information. It is best to go to the horses mouth, so
to say. I downloaded the brochure that I recommended that Anna download and
this is what the law states:

G
IFT CARDS AND GIFT CERTIFICATES
Gift cards and gift certificates are subject to the state of Nevada’s unclaimed
property laws contained in
NRS 598.0921 and NRS 120A.530.
For gift cards/certificates issued prior to October 1, 2007, the following
rules apply:

If the card/certificate has not been used for at least three years, it is
subject to escheatment at
100% of the remaining face value. These cards have a three year dormancy
period. This includes
all gift cards whether they expire or not.
For gift cards/certificates issued on or after Oct 1, 2007, the following rules
apply:

The card/certificate is escheated in the time period in which it expires. There
is no dormancy
period. It is escheated at 60% of the remaining face value (businesses are
allowed to keep 40%).
If the card/certificate has no expiration date, it is not subject to
escheatment and 100% of the
remaining value must be honored indefinitely.

The full brocure can be found here.
https://nevadatreasurer.gov/Documents/Unclaimed/UP_HolderReportingManual.pdf
and it gives a link within there to the actual WRITTEN law.

Anna, I am sure you didn't know about this, however, you do now. All it takes
is one attorney to receive a gift certificate and to be denied using that
certificate and you will be audited in no time. As you can see, KEEPING ALL OF
THE MONEY isn't an option. Period. It does not belong to you UNTIL you
perform the service.

Anna, All this is dependant on your state laws, Nevada doesn't regulate GC's as
much as other states as far as these
escheat laws, (hehe and its not Mississippi divided by any means if you went to
peek at the link Rhonda posted!)

According to that link:
Nevada:
• No fees for the first 12 months
• After 12 months, fees may not exceed $1 per month.
• Covers Gift Cards usable at a single store or chain. Multiple use cards are
not covered

The other link Rhonda posted:

https://nevadatreasurer.gov/Documents/Unclaimed/UnclaimedPropertyBrochure.pdf

contradicts the first link really..

According to one link I found:
Summary of Gift Certificate Laws
Nevada
Expiration – Expiration date or toll-free number to call to enquire about
expiration must be printed on the certificate.
Nevada Rev. Stat. § 598.0921(1)(a).
Fees – Fees must be disclosed and may not exceed $1/month and may not be
imposed within 12 months of issuance.
Nevada Rev. Stat. § 598.0921(1)(b). Effective October 1, 2007, issuers are
prohibited from charging a service fee
for inactivity of less than three continuous years. (2007, Chapter 363)
Gift Cards- Gift cards are covered under the definition of “gift certificate.”
Nevada Rev. Stat. § 598.0921(3)(a)

So maybe in NV, since you did print the exp data you can safely tell this woman
to beat it :) But honestly thats not so in all 50 states!

I clearly understand where you're all coming from in the stand point of
allowing the client to use their $...Really I do

However, this client in question has abused a large number of her services with
me from coming in late, showing up on wrong days, no showing me, going no less
then 4 weeks for a fill, making 2 hour appointments and as she shows up
canceling her 2nd service. The expiration dates on 1 of the GC's was for 2
months out and the other was for 4 months later, so that she would use them in
a timely manner or at least give it to someone that would use them.

I did offer to give her half off towards a service to be fair not only to her
but to myself as well. The GC's in question are now almost 6 months past the
time they should have been used.

With regard to $ unaccounted for in the states I have never in my life ever
heard of such a thing, it must only be on the east coast or mid west cause I
have never heard of that...I am independent contractor and work for MYSELF I
make my own prices, my own rules and my own appointments...If I chose to not
honor a Gift Certificate that has been expired for more then a 6 month period
that is my digression It was her mistake for not using it in a timely manner
not mine...I have had this client for over 7 years and know she has the time to
get services and needs them too so she should of thought more of her money and
my time!

Most reputable business' don't honor a Gift Certificate/Card that are expired
or have no money on then, so why should my business be any different just cause
I work as a manicurist? I think NOT, I am just as reputable as Walmart or
Target!!

I also keep gc money in an envelope and pay myself when I do the service. That
way the money is always there when I do the service. Expired or not.
Anna, I understand why you wanted an expiration date to try to get clients to
get into a routine with their pedi's. You could have the deal expire on a
certain date but if they didn't use it by then they could still use the money.
For example...They purchased a pedi and prepaid for the second one at half
price to be used within X amount of time . If they did not do that then the
money they paid for the half price pedi would become credit with you, but now
the service is at full price. If your pedi's are $30, the two pedi special
would cost $45. If they got the first pedi and then let the second expire then
they should still have $15 credit. Not for a half price pedi but $15 toward a
$30 pedi or whatever service they want. I personally would always let them use
their money toward something. At least dollar to dollar. That is why I always
put a money value on a gc. If someone gives them a gc for a pedi but they
really don't want anyone touching their feet but would be interested in getting
nails then I will let them use that money towards nails. I always put an
expiration date because if my prices go up and they try to use the gc after it
expires then I tell them I will honor the gc for the amount it was purchased
for if they will pay the difference in price. They appriciate that I will honor
an expired gc and they could turn into a good client. Hope that makes sense.
This is just a suggestion and my opinion, I try to put myself in their place. I
forget and let my own gc expire sometimes.

Agreed, and I almost posted that yesterday. The best idea I've had is to get an
envelope, put the money in it, then pay yourself when it's redeemed.
