Of course not. But the programmers of thing like X-Arc no longer get
royalties for it from NC3, so it can't go on the NC3 CD. You bought the
right ito use it when you bought NC2, upgrading doesn't affect that in
any way.

That's not a problem. The problem was people upgrading from NC1 to NC2
and then *selling* their NC1 CDs. The new NC1 owners then tried to
register and get support, believing they had paid for such. This may be
dishonesty or it may be misunderstanding, but retrieving the CDs avoids
either. It's not a new idea, I've had to return old disks to upgrade
other software.

No, they use the software they paid for. What's wrong is reselling it
when they haven't bought a full NC3. Remember, people upgrading from NC2
to NC3 aren't paying the full price, they are paying for an upgrade
only. The upgraded software includes the original package, which means
two things:
They can still use software for the NC2 package
They cannot sell their copy of NC2 unless they stop using NC3 too
