You could certainly do a new magic system (that is, a system for
determining what, when, and how often a user could use magic power) that
was not derivative of OGC.  If you implemented spell effects in a
universal way that didn't interact with the stats of the game, your
spells themselves might not be derivative of OGC.

I could see that kind of system working, for example, in a Lord of the
Rings environment where magic was atmospheric, not quantitative.  Or
even the Force powers as seen in the first Star Wars movie (EPIV) which
pretty much amounted to "the power to cloud the mind" and "the power to
act with total concentration", etc.
