You could certainly do a new magic system (that is, a system for determining what, when, and how often a user could use magic power) that was not derivative of OGC. If you implemented spell effects in a universal way that didn't interact with the stats of the game, your spells themselves might not be derivative of OGC. I could see that kind of system working, for example, in a Lord of the Rings environment where magic was atmospheric, not quantitative.
