Billy Bush lawyer: Bush risked firing if he rebuked Trump

LOS ANGELES (AP) - An attorney for Billy Bush is defending the TV
personality's part in a lewd 2005 exchange with Donald Trump.
Marshall Grossman told The Hollywood Reporter that Bush would have
been fired from his then-job with "Access Hollywood" if he'd been
passive or told Trump to shut up.
Grossman noted Bush was a NBC Universal employee talking with NBC's
"The Apprentice" star.
The attorney, who was quoted by the trade paper online Thursday,
declined comment when reached by phone.
Bush, who joined NBC News' "Today" as a co-host in recent months, was
suspended after the tape became public last week. NBC is said to be
privately negotiating his exit.
Both NBC and "Access Hollywood" declined to comment on the report. A
publicist for Bush didn't immediately respond when asked for comment.

With the Trump comments backstage on Miss USA and Miss Teen USA, plus
Trump's general indifference of saying things regardless of whether a
camera or mic is hot or not, I wonder who owns that footage. Although that
is the least of his problems.

All I know is what I read on the internet. Still, it would be amusing to
see NBC, which has its own news division, suing a reporter and demanding to
see their sources under threat of prison.

There was an apprentice contestant on CNN last night that was corroborating
many of the sexist things trump said.  She also said that she's speaking
now because the 5 million penalty expired after five years.

Who knows of that's true but it's what she said.

BTW. Roker did enter the hospital for hip replacement surgery yesterday
(best of luck) and Carson the Tool is filling in for him as "Today"'s 9
a.m. host.  I assume someone from the Weather Channel is filling in for
Roker for the weather reports.

 Just to keep this updated, Mark Burnett said that he sold his
 production company to MGM a couple of years ago and they own all the rights
 now. Although I did see it pointed out that Burnett is the head of MGM TV.
 In any case the $5 million threat was never made.

 I would not have bothered with this but I got an email from MoveOn this
 morning with a petition to NBC and MGM calling on them to release the
 footage.

I always assumed that an employee would be the one to hand over footage.
And it has to be done anonymously, meaning that the news organization
cannot know the source. This came up when the NYT published the Trump state
tax return with the $916M loss. The reporter went to her snail mail box in
the office and saw the manila envelope. If she knew who sent it, NYT's
legal department would have forced her to sit on it or find another way to
get it out in public. If she knew the source, in a courtroom she could be
compelled to reveal it of face contempt charges.

So in this case the news organization cannot know the source unless
NBC/MGM/Burnett agree to release the footage which they won't.

footage, which they could release on their own. This would be against the
wishes of whoever ultimately controls it, and the idea is that everyone
signed a release form that exacts a $4or $5M penalty. Presumably whoever
released it would be fired, but the idea is to find a wealthy benefactor
who would pay the penalty.

This is a bit of a non-denial denial. Burnett appears to be saying that he
is governed by the same non-disclosure agreement as everyone else. I don't
think the issue is that Burnett will sue people who disclose, but that
anyone who discloses will be held in violation, and owe millions of
dollars. Should such a person refuse to pay, then presumably the rights
holder would sue to force them to pay.

Just to keep this updated, Mark Burnett said that he sold his production
company to MGM a couple of years ago and they own all the rights now.
Although I did see it pointed out that Burnett is the head of MGM TV. In
any case the $5 million threat was never made.

I would not have bothered with this but I got an email from MoveOn this
morning with a petition to NBC and MGM calling on them to release the
footage.

A statute of limitations applies only to prosecution, not employment. The
morals clause of an employment contract will call for termination in case
the employee brings shame to the company. If the shame happens in the
present it doesn't matter that the act occurred in the distant past.

them. Could he be sacked today for something that happened almost 30

I never understood the appeal of BB, and would support firing him just for
being him. I would feel better about disciplining him for this incident if
they specifically cited his role in facilitating the kiss between Trump and
the Soap actress, after we heard their disgusting conversation about it.
That part is not just offensive speech by Bush, but an abuse of his role as
a host on the show.

NEW YORK (AP) - NBC "Today" show personality Billy Bush will likely
have some explaining to do when he resurfaces on the air.
When that will be isn't clear. An NBC News spokesman said Sunday Bush
will not appear Monday as host of the "Today" third hour at 9 a.m., a
job he's held for two months. Further details were not provided.
Bush is the other person on a 2005 tape of Republican presidential
candidate Donald Trump bragging about kissing, groping and trying to
have sex with women who weren't his wife. Bush laughed at some of
Trump's comments, later encouraging an actress to hug Trump.
The 44-year-old Bush has been brutalized on his own Facebook page
since the tape surfaced on Friday. He was working entertainment news
show "Access Hollywood" at the time.

As a long-time journalist, I can say that even powerful campaigns
can't micromanage when leaks bubble to the surface. It can be like it
is in the movies, but often it's not.
There's something odd about waiting this long to find the tape. Access
Hollywood said they were inspired to look after some AP stories about
crude remarks Trump has made about women. It still doesn't pass the
smell test.
This could be great theater tonight. Trump may have worn out his
appeal to the point that he's politically impotent. And Hillary
Clinton may have some great zingers.

First, has it really been stablished that this story came from the Clinton
campaign in any way? The WaPo itself published a story yesterday that the
Access Hollywood people found the clip themselves (apparently everyone was
archives of Trump footage is going through it looking for material). NBC,
which apparently owns Access Hollywood, made them sit on the story for 4
days while their lawyers worried over it (for no obvious reason, except
they had already been bullied by threatened Trump lawsuits). Eventually the
WaPo reporter got an anonymous tip about the footage, confirmed it, and
they ran the story within a day. NBC got wind that the WaPo story was
coming, but rather than putting its already produced story out first, let
the WaPo break it, then published their story on MSNBC.com immediately

Finally, I do not share your overwhelmingly positive view of Hillary's
campaign, and certainly would not put it in the same league as Obama 2008,
which will go down as one of the most effective campaigns in American
political history. I agree that all other things being equal the deck is
stacked against a candidate trying to win a third consecutive term for
their party - but if she was running against almost anyone other than Trump
(the almost is for Cruz), Hillary would very likely be behind right now.
Her campaign was slow and clumsy in dealing with Sanders during the
primaries, and even though they have known about her main liabilities
(email, Wall Street ties) for a long time, they were almost Jeb-Bushian in
their stunning inability to have a competent response to an overwhelmingly
predictable question. They did put on an amazing convention, which will go
down as having been a very important part of this campaign, and they
prepared her very well for the first Debate. But their ground game lags
behind Obama 2012 and 2008, and they are not terribly nimble or strategic
in dealing

I just hope that the obnoxious comments on this tape, along with the
previous sexism, racism and all around bullying see Trump achieve what is
clearly his worst nightmare - to become one of the biggest Presidential
losers ever.

The Apprentice footage belongs to Mark Burnett right? Shouldn't he right
now be shopping NBC an Apprentice Outtakes special? And yes, I realise that
must mean some acknowledgement of how Trump behaved at the time.

I'm reminded of a scandal in UK TV in 2011 when the two main presenters of
Sky Sports were fired for making off-air remarks about a female referee. At
first suspended, an anonymous Sky employee then leaked other off-air tapes
of the pair, at which point they were fired. Their comments weren't
anywhere near as offensive as Trump's. The pair now work for a Qatari TV
station.

It may be airing at 2am UK time tonight, but if it wasn't already, the
upcoming debate is now unmissable.

Two comments on the situation:

post-election wrapup to decide. The campaign was put together in 2015 to
run uphill against the traditional impulse to change parties in the White
House after 8 years. That they got to run against a circus act with a
fractured party behind him was a gift, but they still go full out to win. I

but they waited for the best time to leak it to the Washington Post and it

I don't care what he says in private, though if he's stupid enough to be
that big of a horse's ass surrounded by mics and cameras, I suppose it
matters. But considering the offensive stuff he says publicly, the private
content doesn't matter to me.
