No, the phone isn't muted and sometimes they work fine and sometimes after
tapping two or three when dialing a number they fall silent then come back
and sometimes not.

I am not sure but I would think yes if the update says 8.02 then yes after you
upgrade to 8.02 you should be able to upgrade to 8.1.

Yes, I did experience this on my iPhone5s yesterday after making a few
calls and also after leaving a message for someone and pressing the
associated sequence of keys to review and send it. My solution for
getting the tones back was to quit the phone app in the switcher and
relaunch it
