Why is there any secrecy about the existence of legal proceedings?  There is 
no barrier to truthfully reporting that X has commenced legal proceedings 
against Y claiming $10,000,000 for nervous shock following an outlanding at 
Kingsford Smith Airport on 1st April.

If the existence of legal proceedings, or fear of them, is the reason why 
our ability to fly safely is reduced then the existence of those proceedings 
ought be made public.  If the legal proceedings are kept secret one has to 
wonder whether the real reason is to be found elsewhere.
