I'm in the same boat, minus the totalled car.  Weighing the options between
a 325Ci or 330Ci E46 or a E36 M3, considering both about the same price.
On one hand the E46 offers current styling and most likely higher resale
value when it is time to go (although E46s are like deer around the
DC/Baltimore area - too many on the road).  On the other hand the M3 offers
the horsepower, exclusivity, etc., but comes at a cost of high dollar
maintenance/parts, insurance, etc.

Consider that your 99 M3 with less than 30K miles is selling for at least
$25K???  Consider E46 M3 are on e-bay selling every day for $28 to $38K.
Consider a new 3 series is coming out, followed by a new 4 series (M4),
which will date the M3 even more, but I'm not sure how the value will be
effected.

In January I totaled my 98 M3 and have been looking for a replacement
since.

Frustrated with not finding anything decent (IMHO), I then considered a new
E46 with the Competition Package.

Found a salesman & dealer prepared to give me a fantastic deal on an
ordered
one, and at about the same time I found a 99 M3 with fewer than 30k miles.
If the e36 checks out, I am going to go with that, but am interested in the
opinions of the group, plus was wondering if anyone would be as kind as to
run a CarFax report on the VIN?� (WBSBG9338XEY83317)

Only if you buy a reset tool. (US$120) I have had airbag light problems on 
my E46 so I purchased one. The dealer would want to check the codes to see 
what caused the airbag light which may cause it not to fire in an impact or 
perhaps fire when no impact has occurred. You could get a independent shop 
who would probably reset the light and tell you what the fault code is for a 
minimal fee. Then you could repair the problem yourself. (Assuming there is 
a real problem.) My airbag light faults out typically if the front passenger 
seatbelt was not retracted when a passenger exited the vehicle. HTH

Not according to the 'BMW Assist' microsite FAQ:

Q: Does BMW Assist track my vehicle's location?

A: No, the BMW Assist system only transmits your vehicle's location:
1. When the vehicle initiates the Automatic Collision Notification service
after an airbag deploys or a severe rear impact occurs,
2. When the "Customer Relations" and "Service Request" button is pushed on
2004 and later 5 or 6 Series or automatically when these cars' sensors
detect the need for upcoming service, or
3. When you request service by pushing the "SOS", "Wrench", Emergency or
Roadside Assistance button
4. If you request Stolen Vehicle Recovery service by calling (888) 333-6118
after filing a police report (2005 models produced 10/04 or later, except 7
Series)

The BMW Assist Response Center is able to update location information while
rendering service, but cannot determine the vehicle's location without the
vehicle or occupant initiating a request for service. Vehicle speed or your
previous locations are not transmitted.

I know many new cars equipped with Nav/OnStar/Teletrac, etc. now have the
neat "feature" of being able to have their position located by a spouse,
co-owner, etc. to see where the car (& someone) is. Do the new 545's with
Nav (or for that matter any BMW) have this ability? I have a friend who is
thinking of getting a company car (possibly 2006 545 with Nav in a few
months) but isn't too comfortable if the company has the ability to look up
where he is whenever they feel like it.

Sigh, this rarely happens, but I made a mistake :-)

I was too lazy to actually LOOK UP what brakes were on the race car. They
are of course E46 328 rear rotors on the E36 325 race car. Thanks to Steve
Walsh for prodding me out of my laziness.

And a particular apology to Rob. Sorry Rob.

Big O Tires in West Covina , about 3 blocks south of
I-10 on Vincent. One of the recommended installers by
Tirerack and thats how I found them. They uses Korke
machine.
