I just signed up for that yesterday and I think it should at least be available for O.S. 9.2.2 users. That operating system isn't that old yet!!!!! They should make it available to them for awhile (so they can experience what its like), and then kinda phase out 9.2.2 or "Classic" compatibility. Once people get hooked on it, then they could be forced to upgrade.
I agree that it would be nice if the iTMS was available for OS 9 users, and perhaps it would even be theoretically possible to do -- but Apple is not going to spend that kind of money to implement the technologies underlying the iTMS into OS 9.
There are an increasing number of apps from Apple and other parties that rely on technologies not present in OS 9, and so can't be made to work there without really enormous investments. The next version of Photoshop is going to be OS X-only, and believe me it's not because Adobe wants to spite their millions of OS 9-using customers.
