They gave it to him, that means its his now. He isn't in violation. Just like when someone gives me an MP3...well maybe not.
From what I make out the 'source' has installed 10.3 Server (not available as an upgrade as we all know) which constitutes replacement of the software with another separately licensed product. Therefore he is legally entitled to use it as the license has been deemed obsolete by the original owner and they are using other OS software.
