Well...the OGL is WotC IP, so sort-of.  And WotC may produce OGC that can then be
used in his game.  Right?

But you can make rules compatible with D&D, include them, tell people to use them,
and just never tell them that they're supposed to be using D&D.  And if you have
the D20 logo and the statement "this product requires the use of the D&D3ePH" or
whatever the correct text is, then it ought to be pretty clear to the consumer.
