An interesting question I have based on this discussion is as follows: If you want to avoid an potential infringements, etc, can you redefine the MindFlayers into your own version based on the SRD? Lets say that instead of humanoid tentacle headed monsters as they are known know, I decide I want to make them more octopus like, or maybe something like the old Drider (sp) race.. spider bottom, or even crab-like bottom with a short torso and a squid-like head.. entirely change the appearance, write new background info, etc..
