JohnY I think you are right.The TMO is more and more like a Religion mixed with Non-Democratic Ideas. I think it is hard for a true Muslim and other Religions to accept that. And also people who want Democracy. It seems that TM as an easy, effortless technique to release stress and strain, is over-shadowed by all this weird things. When I do the Puja as a part of the Initiation, I explain that this belong to an old Tradition, because TM belongs to an old Vedic Tradition. Everybody accept it. He is a businessman - and he could easily have paid the price of the TMO. But you explained to him that learning TM from the TMO wouldn't mean he'd have to join a cult, right? No, I did not. I do not argue about the TMO with people. The only thing I say is that I am not a part of the TMO because I do not agree with the course fee. I do not say anything negative about the TMO. To explain what the TMO are or not are, is not my responsibility. People see what they see and make their own thoughts. Oh, I wasn't suggesting that you *argue* with him, just that you let him know what the facts are with regard to that particular concern. And what are the facts? Is it yours and mine subjective meaning or is it what people learn from the TMO itself? I'm not sure I understand the question. Most people who learn TM pay their money, get their instruction, and go off and practice on their own without having any further contact with the TMO, except perhaps for an occasional checking session. Surely you would agree that this is a fact, not a subjective impression? Wherever the TMO may be on the cult scale, it exists to teach people to meditate, not to recruit them into the organization, unlike, say, the Moonies. You have to make a decision to become more involved; and if, like your student, you're wary of being drawn in to start with, it's highly unlikely that you will be. Seems to me the number of teachers who have become independent, or would like to be able to teach without having to go along with all the nutty stuff, is evidence of what I'm pointing out. There's a lot of misinformation being bandied about in the discussion of this situation here on FFLife. Snip Without making any judgments about either side, here are the facts: Big Snip - Basically, he (Mike) seems like a guy stuck in the past, (Hmmm... sounds like a judgement to me.) - living a bit of a self-delusion. (Oops, there's another one.) - he seems to have lost connection with today's TM Movement (Hey, this is a GOOD THING!) - and isn't really producing much real TM activity or TM teaching. (Hmmm... and the TMO is?) - seems way out of touch with reality (Seriously, who's way out of touch with reality in this scenario?) - Mike seems to be a loner; he could hardly get 4 other people to flying sessions (and most weren't teachers) (Well now, there's a slap in the face to all the citizen Sidha's down there in Florida.) - And where are his thousands of students? (H... and where are the TMO's?) Why is MDG so afraid and intimidated by this self delusioned guy who is stuck in his past that he finds it necessary to spend HOURS bolstering his ego writing this endless dribble? Personally, I'm rooting for Mike. I think it's a moot point. As Irmeli and others have pointed out, all that the TM lawyers can do *is* threaten. They're terrified to have this actually come to court, because they could *lose*, and thus lose their precious monopoly. Interestingly, I used to know Mike Scozzari. I gave my first TM lectures after teacher training down in Florida, and he was already there and already enthus- iastic. Although I haven't seen him since, I'd be willing to bet that (another value judgement here) he's simply more committed to the original idea of TM than to the reality of TM as practiced and taught by the modern TM organization. The idea of TM was to make a simple, easily-learned technique of meditation available to anyone who was interested, at a reasonable cost. The reality of TM is that it's the new gateway drug to involvement in a cult, and is priced in the same neighborhood as cocaine. I think Mike's approach is a good one; you can tell *how* good by the extent to which the new drug pushers of the TMO react to it and the extent to which they attempt to demonize some- one who still believes in ideals that they have sadly forgotten. The side of a dedicated TM teacher who wishes to continue honoring his original commitment to teach a potentially valuable technique of meditation at a reasonable price and who wishes that the organ- ization that represents that technique still felt the same. They *really* wouldn't want me as a witness in such a case. I spent several years at the TM National Center in L.A., in a position where I was privy to all sorts of illegal moneylaundering and coercive activities with regard to TM teachers. Me, I don't teach TM any more and never will again, but I do feel for someone who wishes to do that, honoring his original commitment to the TMO and wishing that they had a similar sense of honor to those they had commissioned in the past as teachers. I have mixed thoughts about the independent teacher in florida. I know from experience how challenging it is to run a local center, it requires tons of dedication. This guy has been doing that for decades apparently and his heart is invested. The new certifiables don't have that emotional investment in the community and may indeed be long gone from the area as soon as the NEXT BIG THING is announced in 4 months. I don't know how unrealistic he is, as mdg discussed, as he has a real job and does 7 steps in his spare time, teaching whoever happens to show up. What's he supposed to do - join up with the certifiables and make a presentation to the mayor on bulldozing downtown Miami in order to bring about world peace? More than likely, a good TMO lawyer could get any and all witnesses/testimony/facts pertaining to these points excluded automatically. They *really* wouldn't want me as a witness in such a case. I spent several years at the TM National Center in L.A., in a position where I was privy to all sorts of illegal moneylaundering and coercive activities with regard to TM teachers. And you probably wouldn't be called because any such testimony is irrelevant to the question: does the TMO have the right to say who can and cannot use its registered trademarks? Me, I don't teach TM any more and never will again, but I do feel for someone who wishes to do that, honoring his original commitment to the TMO and wishing that they had a similar sense of honor to those they had commissioned in the past as teachers. I do not argue about the TMO with people. The only thing I say is that I am not a part of the TMO because I do not agree with the course fee. I do not say anything negative about the TMO. Kindly tell him that his assertions that I am in infringement of the service marks in question does not necessarily make it so. If such an action were brought by him I along with many other TM teachers with whom I am in contact would be strenuously and vigorously contesting his allega- tions in a class action suit. When Maharishi's focus changed away from ini- tiations, and the local center(s) here closed up, Mike continued to try and teach TM and had trouble adjusting to all the new stuff. When the price of TM increased in the 90s, he balked, and set his own pricing. When I first moved here a couple of years ago from Fairfield, I saw his TM ad. So I went to his advertised location for the introductory lecture, to introduce myself to him, to check him out, and to see what kind of local meditating community there might be. He told me that he'd been renting this conference room in a local Kinko's on Federal Hwy. in Boca Raton every week for quite a while. He'd advertise an intro lecture, and show up - but he admitted to me that hardly anyone had ever attended. The night I came to meet him, it was just he and I, and we talked and got to know each other for over an hour. He told me that he's married, and he's a traveling sporting goods sales- man by day. He said that he had some interest from a couple of companies to do an in-house TM presentation, and maybe a course, for them. I men- tioned that I'd helped design the old TM business program (AFSCI), and taught it in Chicago in some big companies, and I'd be happy to be of ser- vice (even go with him to give the presentations without any compensation). About a year ago I had the opportunity to speak to Mike S. I admired his tenacity and the fact that he was teaching regularly. Four people a month is probably more than the re'certs are doing. I guess it all depends on whether you think the TMO should honor it's agreements with teachers or not. And whether the TM Organiztions should actually teach the TM technique or just raise money. Part of the long-term agreement between the meditator and the TMO is that all TM teachers will check meditation of anyone taught by any other TM teacher. Without quality control, and a network of mutual obligations as defined by monetary exchange, who can say who learned what from whom? The TM org as the central coordinating body for keeping the teaching pure requires at least SOME money to keep its doors open. And as long as the TM teacher is representing themselves as a TM teacher, they're cashing in on the advertising and reputation of the TMO, which has spent a LOT of money and time and effort to create the market for TM. No, the TMO may not have pursued people with a vengance before now, but unless the judge rules that they didn't put enough effort into protecting the trademark previously, the TMO stands to lose MILLIONS in the next few years and they WILL pursue people now. Mark my words, etc. Stop kidding yourself. The 'recertification' was just so that the TMO could charge existing TM teachers (that is, suckers) some extra money TO be 'recertified.' That and get them to sign up-to-date legal agreements that would be more binding. In the process they turned off most of their most ardent supporters among the TM teachers who were still teaching. It's ALL about money. And they will NOT pursue any of these things beyond the point of making vague threats. They simply cannot afford the possibility of a real court case, because too many things about the TMO's cultlike nature would come out in such a case, and there is a good chance they'd lose. The TM teachers ARE salesmen, BTW. Who do you think does the actual work of putting up posters, giving lectures, and teaching new people? It certainly isn't the movement; they're doing everything in their power to HINDER more people from starting. Kindly tell him that his assertions that I am in infringement of the service marks in question does not necessarily make it so. If Mr Goldstein feels that there has been some infringement, his remedy surely lies in bringing the matter before a court of law --not in complaining to you. If such an action were brought by him I along with many other TM teachers with whom I am in contact would be strenuously and vigorously contesting his allegations in a class action suit. As a self styled copyright attorney Mr. Goldstein ought to know that copyright matters are often complex and can only be decided by a court of law after carefully hearing both sides. Mr Goldstein should be told that a magazine such as yourself cannot be expected to get involved in complaints of this nature and that you have no intention of getting involved simply on the basis of his allegations. They are at best his point of view on the matter. If and when the matter has been decided by a court of law in his client's favor then and only then should he approach your magazine in the manner that he has. Until then, you can take no action on his unsubstantiated allegations. That is the end of the matter so far as your magazine is concerned. Indeed, this is the only position you can fairly take in the circumstances. Were you to take action on Mr Goldstein's allegations you would be doing a great injustice to legitimate clients like myself who have been doing business with you for a considerable period of time. Early on the same TM legal dept. sent him many very scary *cease and desist* letters which, though they scared my friend, did not stop him. I was mistaken. Mike was not recertified. Then it will go back to any prior contracts, and who actually owns the trademark. My guess is that he won't be able to advertise atthe least, and the TMO may have to buy him out, but if the court actually orders him to accept payment for his loss of use of the trademark, he's SHOL. And, unless the TMO loses ownership of the trademark, I can't imagine any judge ruling that the owner of the trademark can't control who uses it in a commercial setting. Note that I'm not a lawyer, but this is the most obvious common sense way for these things to be dealt with so unless the law gets REALLY convoluted, I suspect that that is what will happen. Yahoo!
