[videoblogging] Hosting Ideas?

2006-03-02 Thread Ms. Kitka
Hey all,

I currently have a LibSyn account and it seems like they've changed
some policies without telling me so I'm not too happy with their
service at the moment. I'm considering moving to another host, but
have a few criteria:

- Need between 90MB-150MB of storage per week... at most 675MB/month
(I currently use about 100MB storage per week, but it would be nice to
have room to grow);
- Able to host mutiple file types (QT, Windows Media, etc.);
- Unlimited bandwidth;
- Fast download/upload (wide pipe);
- Reliable stats;
- Please don't bother suggesting Blip, YouTube, Archive.org/OurMedia, etc.

Let me know if you have any professional suggestions.

Thank you,
Kitka

[videoblogging] Re: OT-Torino Olympic Closing Ceremony

2006-02-28 Thread Ms. Kitka
I didn't see the closing ceremonies but I was blown away by the
opening ceremonies (partly because some of it reminded me of my
favorite sci-fi film, Logan's Run). Although I was very impressed, I
can help but be reminded of the sheer number of people out there in

of putting on a production like this is astronomical... amazement has
a heavy price.

[videoblogging] Re: When video services scale up your videos dimensions

2006-02-27 Thread Ms. Kitka
I think the videos should be shown at whatever size they were made...
things are going to change in the near future and these sites will
have problems if they choose to control the size of video.

Rumours are circulating that the NEW video iPod will be 16:9, so I
have no doubt that more people will be making videoblogs in
widescreen. I've been thinking of this for a while, but I've decided
that I need to invest in a background first! Rocketboom has just
started broadcasting in widescreen with their new HD cam, so as more
and more people do this (I'm sure RB's not the first), aggregators
will just have to adjust.

Resistance is futile... you will comply.

[videoblogging] Adult vlogging revenues (was Re: echoes of FEM)

2006-02-24 Thread Ms. Kitka
You're half right, Stephanie, I do dress in lingerie and read the news
but it's usually not AVN... it's mostly mainstream sources like
Reuters, BBC and the New York Times. These are all stories covered by
the mainstream, I just happen to be sarcastic about it and wear about
as much clothing as someone playing beach volleyball (perhaps even
more!). I agree that my content is explicit (I've used the F-word a
couple of times), but the delivery of it is not adult.

I have no interest in venturing into the realm of subscriptions or
removing my clothing and becoming a porn star/erotic model. I
wouldn't mind doing a Women of Vlogging spread in Maxim, but I have
no desire to become the next Jenna Jameson. I also recently removed
all banner advertizing from my site (Google AdSense, Amazon
Associates), I don't want any annoying banner ads to ruin the
experience of coming to my site to watch the show.

When I started Kitkast I just wanted to make a video extension of my
sex blog which dealt with censorship, religious intolerance and the
government. If/when I allow video advertising on my show I would
prefer that the ads were non-pornographic. People don't keep watching
the show for porn, they watch it for the comedy and tittilation... and
I have made a concious choice never to show nudity (although, in
episode 1.15 I showed nude paintings in an art gallery... nothing you
wouldn't see on PBS!).

Don't get me wrong, I do have plans in the works... but when I first
started Kitkast I had no intention of making any money. The only
reason I would like to make any money now is so that I don't have to
work 35 hours a week at my regular office job and 25 hours a week on
Kitkast. As you've seen in Four Eyed Monsters, the stress can really
hit hard on our personal relationships.

I appreciate your input, but please understand that I have no desire
to become heavily associated with porn. I would, however, love to
become heavily associated with sci-fi... ;)

[videoblogging] Creative Commons Video Inserts?

2006-02-23 Thread Ms. Kitka
I've been impressed at the way some people put Creative Licenses on
their videos and was wondering if there is a place to find good
quality open source versions of them. Michael Verdi had a nice one at
the end of his father's vlog that I was drooling over and I'm sure
most people make them themselves.

I spent a couple of hours fiddling with my outro the other night to
make a nice new Creative Commons video clip that includes the symbols
of Attribution, No Money and Share Alike... is there a place to find
and use these already made or do we just have to do it all ourselves?

It would be nice if Creative Commons could make some kind of standard
for us to use if we want to...

2006-02-22 Thread Ms. Kitka
emWhat's in a name? A videoblog by any other name would still have
an RSS feed.../em
- Kitka Shakespeare, 2006 A.C.E.

To me videoblogging has more to do with the video being available via
RSS... this is what truly sets it apart from regular video on the web.
The blog is simply something that facilitates its distribution/broadcast.

When it comes down to it, most of my viewers have never seen my web
site/blog page anyways... at least 95% of my audience downloads
Kitkast through iTunes/iPodder/FireAnt/MeFeedia/etc. Hencewhy I have
aborted all attempts to place advertizing on my blog page!

Kitka
http://www.kitkast.com/

--- In videoblogging@yahoogroups.com, Bill Streeter [EMAIL PROTECTED] wrote:

This is an interesting question. And it kinda goes to my own working
definitions that I've expressed here before. I don't happen to
believe that videoblogs are defined by content as much as
methodology. A videoblog to me is simply video on a blog. That is
video posted in a blog format, which is a regularly updated website
where content is posted in cronological dated posts. It may or may
not have an RSS feed, comments, a blog roll etc. But it always has
chronological dated posts on a web page. Thus the name Web Log. The
whole personal vs show thing to me is kind of a weird way of looking
at it. The first blogs I read were political blogs and they most
certainly weren't personal journals. I understand that the personal
journals, that a lot of people understand blogs to be, are a genre
of the form, but I wouldn't ever say that a defining characteristic
of a blog is that it's personal. So to my thinking if a video blog
is simply video on a blog then it's not necessarily personal. To me
saying a blog or a videoblog is by definition personal is like
saying TV is all sitcoms or all films are documentaries. A blog is a
media form, and that form has genres, personal, political, artistic
etc. The beauty being (which is kind of the beauty of the Internet
as a whole) is that it's simple for any individual to do without
much help or particular technical expertise, and that makes personal
 forms or genres possible.

The other thing that I've been thinking about recently is if there
is or isn't a difference between a videoblog or a video podcast. And
this is what I've been thinking: if we accept the premise that a
videoblog is simply video on a blog and we say that a video podcast
is the same as a videoblog then conversely a podcast is the same as
a blog. Well, we know that that's not true. What we know (or at
least the way I see it) a podcast is simply multimedia distributed
via a rss feed. So accepting this definition then a video blog can
also be a video podcast, or not if it is video posted in blog form
sans an RSS feed. Also a person can post video to the internet
outside of the blog form but still deliver it on an RSS feed. This
would be a video podcast that isn't also video blog.

So if you accept these definitions (and I'm not saying that you have
to) then what the people from Four Eyed Monsters are doing is not
video bogging, but video podcasting—since they are primarily
publishing video via an RSS feed sans the blog form. They do have
blogs, but on Myspace, and that's not where their video feeds are
 posted.

So those are my thoughts. It's not something that I feel is set in
stone, but that's just where my head is at with it at the moment.

[videoblogging] Rocketboom in Widescreen?

I was wondering. Today's RB episode is in Widescreen (the site .mov

iPod screen size or did they just feel like broadcasting in widescreen

Curious,

I guess it's possible... if I had a budget to work with I would
purchase an HD camera too. I look forward to seeing tomorrow's show
just to see whether this large size will be a daily occurance or just
a one-time gig... after all, RB has made many changes before.

Alternatively: Perhaps after seeing their show on CSI, they decided to
make their site look more like the CSI-Rocketboom site... larger

[videoblogging] Re: Consumers Crave Web-Based TV

2006-02-16 Thread Ms. Kitka
This is the exact same subject I was going to approach after Bill
posted the survey showing that people prefer watching video on their
television screens. The whole thing makes sense because you get to
sit on a comfy couch and the video takes up the whole screen... who
WOULDN'T want to watch all their favorite shows like that...

As someone raised on Star Trek, though, I understand that we must find
a way (besides TiVo, which is not available up here in Canada) to make
it easier to place our favorite web-based content on our big screen TVs.

[I wrote a whole bunch of other stuff here, but I ended up just
babbling.] The truth is, we basically have all the technology we need
right now... we just need:

a) someone to explain exactly how to set everything up or someone to
put out a product that will open internet content to our television
screens;
b) to make sure our videoblogs are good quality so that they look and
sound alright when they're blown up to fit our TV screens.

I'm needed on the bridge,
Kitka out.

Points North: Consumers Crave Web-Based TV by Gavin O'Malley,
Wednesday, Feb

content available on consumers' TV screens as well as their PCs.
That's the
conclusion of new Points North Group research to be released today,
which
found that while 25 percent of Internet users are interested in watching
downloaded TV shows and movies on their PCs, 38 percent expressed
interest
in watching that same video on their TVs.

Getting Web-based content to the TV should be the industry's
primary goal
and will unlock by far the biggest revenue opportunities, Stewart

Interest in watching content on TV is even stronger among 18-

interested in
watching on PCs--concluded the study, conducted in association with

So, if this many people are making videoblogs about those who choose

those who choose to attack others? I sure think so.

The reason these people are making videos outlining the frustration of

they brought it up in a post here.

I propose change... Vive la revolution, and all that.

[videoblogging] Re: anyone get a response from TIVO for their Videoblog Project

2006-02-09 Thread Ms. Kitka
I never heard from them either. All I know is that Rocketboom
currently has an exclusive contract with them and that TiVo is using
them as an experiment. They are apparently testing everything with
Rocketboom (technologically) and once it is up and running, TiVo may
add more videoblogs. Andrew spoke about this in his interview with
Business Week (the podcast).

There is an increasing demand for Mobile content, but my show is too
large for people to download to their cell. My boyfriend and I are in
the process of mobile-ifying our web sites to make them accessible to
mobile phones, though. My new site design will launch this weekend.

I think the problem with PSP is the limited storage space. We have
considered making Kitkast available for PSP, but I think it also has a
16:9 screen and we don't have a PSP to test it out on, so the idea is
on the back burner.

iTunes is definitely a link to have if you want a broad audience...
more than 90% of my subscribers watch the show from iTunes. I was a
little surprised the other day, though, when RB added an iTunes link
under their embedded video... I wonder if other sites like FireAnt and
MeFeedia will be shaking their fists at the link.

My two cents,
Kitka

 Obviously, Rocketboom is off running.

I noticed Rocketboom has several links for various distribution

 quicktime | win | torrent | phone | psp | tivo | itunes

The phone, psp, itunes are of interest to me, because they are
portable devices w/video capability. I am interested in these new
mediums as part of the Content/Distribution model. For the iPod/
iTunes is especially exciting, with 42 million out there (

Music Store (w/revenue-stream). It has a LOT of visibility, is
popular with young generation (hip/fashionable/cool device). Guess
Jeans is making iPod compatible jeans, automobile mfrs are making
their radios iPod compatible (Mercedes, Toyota, Chrysler, Ford).
 What about:

2006-02-08 Thread Ms. Kitka
Rocketboom have given us some amazing tips for videoblogging, yet
people are greedy and want to know private information? I'm not about
to tell anyone what MY paycheck is at my day job, so why should RB
have to explain themselves on every little detail?

I think that it's good that RB keep an air of mystery about their
earnings and source of income. After all, salaries are often a cause
for jealousy in the workplace... and we already have enough jealous
and hurtful people ready to pounce here on this message board.

Welcome to the public eye is not a justifiable reason for the
attacks, this is supposed to be a videoblogging group, not an RB hate
group.

Can't we all just... get along?

[videoblogging] Re: Rocketboom Changes?

2006-02-07 Thread Ms. Kitka
I'm assuming that Andrew set a reserve beyond any expectation (one
ludicrously high such that it cannot be met) to give him discretion over
accepting a bidder. Note the terms: he reserves the right to refuse any
bidder. Yet, had a bidder won, he would have entered into an
agreement --
via ebay -- whereupon he would have to deliver the ads. This gives him
 discretion.

 (speculation)

Well, $15,000 isn't a lot of money for a high profile show like
Rocketboom. As Andrew has previously mentioned, RB has already been
talking about CPMs from $50-150. If this is so, why would RB submit
to such a low paycheck when they're already having offers of much more?

I've done the math before:
http://groups.yahoo.com/group/videoblogging/message/33287

If you take the minimum $50 CPM, that makes $50,000/week. Doesn't it
make $15,000 look like charity?

[videoblogging] Re: Rocketboom Changes?

2006-02-07 Thread Ms. Kitka
I'd be interested to see what the CPMs are like for ads playing on MSN
Video before news segments. There must be a market out there that
already has a set CPM rate, but the cost is probably similar to
advertising on television because sites like MSN are gargantuan!
Still, that does not negate the value of RB since CPMs work
proportionately to your audience size.

Besides, how do you put a value on ad space in videoblogs? Audio
podcast time isn't as valuable because you can make an audio show that
goes on for one hour... but video space is more valuable because of
how quickly the size of the show escalates. It's hard to compress a
show to a reasonable size and keep it looking good.

A 30-second ad at the end of a 3 minute show like RB is a considerable
size... so why not demand high CPMs? What Andrew is doing now is
setting the market for the future of videoblogging. Let's watch, see
what happens and offer our assistance when needed... this is what the
community should be.

Kitka

--- In videoblogging@yahoogroups.com, T.Whid [EMAIL PROTECTED] wrote:

Andrew thinks the show is worth $50 - $150, that doesn't make it so

price is much lower than $50. Andrew believes that RB-type of video
is a whole new market that hasn't had a price set for it yet (please
 correct me if I'm wrong).

That's the purpose of an auction, it creates the price. The price is
what the market decides it wants to pay for it. Of course, Andrew
doesn't have to accept whatever this price turns out to be.

I'm don't answer for Andrew, but RB does have a CC licence that

   1) Podtrac, an advertising sales network
  and
   2) The producers of Rocketboom, a three-minute daily videoblog of
 news and comment

Not that Podtrac is producting Rocketboom, but that the producers of
Rocketboom have an online auction (which has been discussed a bit.)

The only good thing about .m4v is that they tend to look better if you

I've never been able to get them to play as they download like
a .MOV does. Yes you file must be h.264 or .mp4 to work on an ipod
(movs can be encoded with these). Also the M4V extension is just
another extension for MP4. You can change the extension to .MP4 and
 it will work just fine.

Or do the users have to convert the .mov into mp4 to use it iPod?

If your file format is not H.264 or MPEG-4 then it won't work on

Either way, it's evil of them to code it so that it automatically
opens in iTunes. In Windows, iTunes is MUCH different... it's like a
hyperactive child that forces you to pay attention to him (ie. it's
difficult to use any other programs while iTunes is running). The
reason being that iTunes for Windows is programmed so that it has a
whole bunch of redundant code to make it LOOK like it's being played

This is why I hate the fact that the default program to open .m4v

[videoblogging] Re: Rocketboom to Auction Advertising Time on Ebay?

2006-02-02 Thread Ms. Kitka
Actually, Kunga, if you take into account Andrew's post saying that
they were looking at CPMs of $50-150/episode
(http://groups.yahoo.com/group/videoblogging/message/32269), that
would be approximately:

$50 CPM x 200 (ie. 200 thousand viewers) = At least $10,000/episode
$10,000/episode x 5 days = $50,000/week
$50,000 x 52 weeks = $2,600,000/year

Which means...

$50-150 CPM = $2,600,000-7,800,000/year

That's even more than what Jeff Jarvis from BuzzMachine.com quoted to
the New York Times a couple of months ago. He originally mentioned
that RB could sell ads for approximately $8,000/show and make a
$2,000,000 annual salary.

Of course, if RB wanted to do this full time they may need to hire a
small ad production team to keep putting out innovative content. This
won't be a problem if they are able to establish a steady paycheck.
Heck, I know I'd quit my day job and live off peanuts to join a team
like that...

As always, wishing them luck in their future endeavors.

I imagine they will produce length according to how high the winning

Currently the price for an ad is $15/thousand viewers or CPM in ad

Let's say the winning bidder get sthe ad space at $50 CPM, or
$50,000 to
advertise for an entire week and get one million unique viewers.

RB can then take that and say use that $50 CPM as their baseline. If

 $50k! A
Month -- $175K (give em a break for buying in bulk). Done and done.

[videoblogging] Daily Vodcasts???

2006-01-31 Thread Ms. Kitka
Okay, this is the third time I try to post this I'm not even going to
try to write eloquently (the first two haven't shown up)...

Does anyone know how to get into contact with the webmaster of
DailyVodcasts.com? I've been trying to find his name and contact
details because he's aggregating the RSS feeds of Kitkast and other
videoblogs and posting it all on his own site. He even has his own
RSS feed to redistribute other people's content on sites like FireAnt.

I find it terribly shady that his name is not available on his site or
on WhoIs. He started his site in December 2005, but is aggregating
content from as far back as March 2004.

Please do not hesitate to contact me should you have any information
on this matter.

Thank you,

Sully... I've tried whois.org, but it's not listed with his name and

Enric... It is definitely automated from my RSS feed to his web site.
The reason I know this is because I added some special features to my
RSS feed (Email this, Add to Delicious, Comments) and those show up in
the post! Since not all videobloggers use the extra feed stuff that I
stick in, they probably never got any trackback notifying them that
someone is doing this. I only found out because the comments in my
RSS feed was tracking back to my site.

Don't you hate when you think of something awesome but don't grab hold

knew that it would be a successful publicity stunt, but I didn't do it
because my parents still don't know about my show and I didn't want to
do something so public without warning them first!

The other reason I didn't do it was because Ebay may have taken down
my bid for the same reason as their sister company PayPal closed my
account; the dreaded adult content guidelines. There may be no
actual adult content on my show, but these jerks over at PayPal/Ebay
just love to crush anything sexual with their iron fists.

Good luck to the Rocketboom team!

There doesnt have to be ads in the actual videos. Find an alternative
to having Eat Rice Crispies every morning played before I am
allowed to see the video. Dont hold me hostage while I wait to see
 the content.

David, the last I heard Rocketboom was going to place ads at the END
of their content, not before.

I have no doubt that Rocketboom work their asses off to put their show
out as regularly as they do. So, why can't you understand how
important it is for them to make an extra buck by providing advertising?

Most videobloggers don't put out 5 shows per week, so how are those
devoted to providing this amount of content supposed to keep doing it?
Also, what is better than making a paycheck from your hobby? Most

David, I urge you to read the terms of the auction:
http://cgi.ebay.com/ws/eBayISAPI.dll?ViewItemssPageName=ADME:L:LCA:US:11item=5661816188

Rocketboom is not only selling advertising time on their videoblog,
they are making the ads themselves, placing them at the end of their
show and making them in such a way that their viewers will actually
enjoy the ad.

Why do so many people here think this is such a horrible thing? They
are being creative and taking their audience into consideration all at
the same time. Besides, it's not the first time they've aired
advertisements on their show... they've been doing that for a long
time (my favorite was the Flickr ad).

Lighten up people.

[videoblogging] Re: The Rocketboom Boom

2006-01-30 Thread Ms. Kitka
I was thinking about the auction and some of the discussion it
triggered. I was wondering if there were any envy involved. Not
saying there is, just wondering...

I have to agree with you, I have no doubt that there are many jealous
people out there wishing they had the number of viewers and an income
from their hobby, like RB.

And then I realized what the auction is really going to trigger.
Everyone is going to know how much Andew and Amanda will be making!
Right now, I think it will be more than a tidy sum. Because it's on
eBay, the information will be public.

Whatever the amount they make from this is well deserved for their
innovative approach. The more press Rocketboom gets for their
creativity, the more chances all videobloggers have of becoming more
popular.

Andrew has been incredibly generous in sharing information about
vlogging with us. But this is going to be earthshaking.

Andrew has been very generous and I find it insulting that some people
on this message board would attack his tactics (especially without
reading the eBay listing fine print).

I hope the vlogging community can survive it!

People are always talking about a vlogging community but I have yet
to really SEE one. All I see is a group of pundits on a Yahoo Group
who attack each other for every line they write. Gees, I mean, people
are even attacking Capitalism today! Is the vlogging community
supposed to be a community of communists? I sure hope not.

 Stan Hirson

I truly wish this videoblogging group was more about helping each
other than attacking each other... then it would truly be a community.

2006-01-27 Thread Ms. Kitka
Thanks Paul and Klaas, I'm a very lucky girl... I got the tape to work
and I uploaded all the footage last night to my PC just to make sure I
had a good copy that wouldn't get tangled up again (the original plan
was to just do the editing directly from the DV Cam, but that's not an
option right now). My show should come out tomorrow as usual and I'll
take my cam back to the store on Sunday.

Paul, you might be right about the cold-warm condensation idea...
Montreal was pretty damn cold on Wednesday. The cam was in my

I definitely need to make sure the cam works for the future, my

[videoblogging] Re: What does Apple like in a Video Podcast?

2006-01-25 Thread Ms. Kitka
Mark,

I was reading about how to be a Featured Video Podcast on iTunes the
other day and (off the top of my head) the requirements were as follows:

- Show image must conform to iTunes' standard 300x300 pixels;
- Must have an in depth description;
- Must be properly categorized (ie. This or That = Entertainment,
Kitkast = News, etc.);
- Sexual content will not be featured (which probably means you and
me, kiddo.)

Btw, I'll be reviewing you on my show this week... This or That TV
will finally have a place on Kitkast... ;)

I posted this recently in the new Apple 'podcast producer's Forum'.
I don't normally cross post my opinions but I thought folks here might
have something to say about it...

 http://discussions.apple.com/thread.jspa?threadID=328594tstart=0

I am a producer of a video podcast that represents a completely
independent (no money) television show and the work of over 30
volunteers. But, it seems that we are not the kind of video podcast
that Apple likes. And so we are trying to figure out what Apple does
like.

 Our podcast:
This or That! America's Favorite Burlesque Game Show
 Video blog: http://thisorthat-video.blogspot.com
 Video blog feed: http://feeds.feedburner.com/ThisOrThat-video
 ITunes Podcast listing:

http://phobos.apple.com/WebObjects/MZStore.woa/wa/viewPodcast?id=74172010

We were thrilled to hear that Apple would add poddcasts to iTunes and
were one of the first podcasts listed back last June. We have been
posting in the mp4 file format (video ipod compatible) since June as
well.

We were also listed by mefeedia, an independent video blog directory,
aggregator, and web based player last spring. Mefeedia lists over 4300
video blogs that you can subscribe to.
 http://www.mefeedia.com/feeds/
And we are listed on at least 20 other podcast directories that list
video podcasts, I use mefeedia as an example because they cater
 exclusively to video podcasts.

We have never been a featured anything in the iMusic Store and are
baffled by how Apple chooses what they like. Near the top of their Top
podcast list are French Maid TV, and Tiki Bar TV. Well, folks say you
need a little titillation to keep the Apple programers happy. But not
so, we are a burlesque show with plenty of salacious activities,
visual excitement, and an explicit warning, but this does not get us
onto any of Apple's prefered lists.

Well you need to be popular Apple says (in their official FAQ listing
of what it takes to be a featured podcast). Well we are popular, just
not with Apple. On mefeedia, we are the 4th most popular video podcast
out of over 4300. But on Apples site we are below the noise floor.
(Its worth noting that the top 3 on mefeedia are not in Apples Top 100
 either).

We have only 5 star reviews on Apple's site and no bad reviews (so
 far) on mefeedia or Apple.

As for Apples other technical requirements, we meet them all.

Including the fact that our video podcast is taking off. It is being
seen around the world, with a larger audience than we would ever have
achieved on public access TV or even as a regular web page.

We realize that Apple has no reason to be fair about this, they are a
corporation attempting to make money after all. If fairness (or the
promotion of home produced podcasts) was the point, Apple would simply
rotate the featured podcasts, say every week or so, so that all
decently produced podcasts would get a chance to be seen and heard.

Apple does not seem to be in business to support or promote home
grown independent efforts like our own (and most of the podcast
community). They seem to have decided that the only way to make money
is to promote commercial products, like all those FOX podcasts, and
now the NBC and ABC television libraries.

The Apple FAQ states, In most cases, we avoid promotion of podcasts
that are themselves merely promotions for other media products, such
as films or albums. But that statement is at odds with what they do
feature. If they are going to make this kind of statement they need a
new category: Featured non-profit podcasts. There are many of us who
have produced `other media products, such as films and albums' and TV
shows that have had little success in other forms, but when they are
translated into podcasts, folks start listening and watching.

It seems this statement, we avoid promotion of podcasts that are
themselves merely promotions for other media products, such as films
or albums, really means, we avoid any content that might compete
 with our revenue generating content.

I realize that this may sound like sour grapes on my part, but we are
 genuinely frustrated here.
I would love to hear other independant podcast producers tell me I am
 wrong.

Have a look at our podcast if you like.
Let me know if you have had a similar or different experience. I would

Look people... I've used short clips of video and music under Fair Use
and have not infringed on anyone's copyrights. All clips (and notice
I use the word 'clips' because I have never used someone else's work
in full, only in part under Fair Use) are used for news and criticism.

Go here for the Coles notes version -

Generally it would not be the artist themself who went after you -

Anyway, I personally dont have a problem with it, but I don't think we

there are way more layers in music (publishers, mechanical rights,

The big difference with RSS-based media is that the sponsorship

Assuming that the CPM is $25 and a single video gets downloaded
   10,000

would make the value of a single video sponsorship at $250 for

Of course, there is an exponential decline in viewers since the

gets pushed further down into the feed/archives. So maybe the

Seems realistic to me, but wanted to check how others feel

   Friends and Family

   is that breaking any laws?

I mean its my CD so why can't i put MY pictures to music and share
   it with people??

The answer: no one knows yet.
The laws regarding use of copyrighted works were written to be
intentionally vague. The plan was for the law to have a large grey area
so a judge could decide on a case-by-case basis what's right and what's
not. The world has changed a lot, very quickly, however, and this new
world we live in is, well, new! What does it mean for a ''regular
person to make a movie using protected work and put it on the internet
for a handful people to see?? I don't think a case like that has ever
come before a court for a decision, and since the laws passed by
legislators and previous court cases don't deal with this issue, then
there is no law about it yet.

Meanwhile not only has the internet changed broadcasting, and computers
have broken-down barriers to entry to creating films and media... but
also corporations have taken over more and more, buying up the rights
 to more and more.

Really I think there are two issues here:
 what is legal, and
 what is respectful.

I see no need to respect the copyright on Happy Birthday (which was
owned by AOL/Time Warner... who's got it now?) If you are making a
feature film to distribute in theaters, you have to buy the rights to
use the song -- and it's incredibly expensive. The song was written in
1893 by Mildred and Patty Hill, with different words, and so the
artists are long gone. AOL Time Warner is just using the legal system
and their power to make as much money as possible without regard to
what the song means to us as a culture. So... if I get together with
friends and sing happy birthday in a restaurant, I'm not going to worry
about paying a fee for a public performance of a song. That's totally
ridiculous. If we videotape the moment, and I post it to my videoblog,
I am also not going to worry about it. Of course, I don't want the
wrath of AOL Time Warner lawyers upon me... I make less than $20k a
year, how in the world could I afford to defend myself in a lawsuit
BUT A HA! I am not alone. I'm sure if I got a seizt and desist letter
from AOL, I could contact American University and all these non-profits
working on fair use and they would jump on the case, donating their
services and taking care of the thing for me. It would be a great case
to see happen, and could mean breaking the hold of these ridiculous
 money-grabbers!!

Meanwhile, at the same time, there are many examples where it's grey as
to whether or not I have to get permission to use someone else's
work, but I decide I want to, because it's the right thing to do --
it's the respectful thing to do. I can use my own judgment, and not
worry about the law. If a local band is selling their first album,
it's great exposure for them if I use their song in my videoblog. I'd
make sure I credit them, and link to their band website where people
can find out where they are playing and buy their album. If I knew
them, I'd probably let them know / ask them if it's okay. But for me,
if I didn't know them and didn't have time / felt too shy to find them,
I'd use their music anyway. It is great exposure for them -- if Good
Morning America wanted to do a spot on them, crediting them, but
without paying them, I'm sure they'd be thrilled!!!

If however, I had some project going where I was going to make money --
like I'm selling videos, and I take their music, and especially don't
credit them, but rather take advantage of a situation and even try to
pass off their art as my own -- well then I'm doing something wrong. I
say if it feels like stealing, then don't do it!! Even if you could
fight off a lawsuit and win. It's still wrong.

But to your original question -- does every home-movie maker who wants
to use a mainstream song off a CD for their photo slide show or movie
of their kids have to worry about copyright violation?? I say no. Apply
created iPhoto and iMovie to let people do this very easily, and did
demonstrations of this very kind of project, and no one said, hey you
have to get Madonna's permission to use her song with those pictures of
your dog. I think publishing the movie to the web is just a step
further... and still should be allowed.

Again, there is no law drawing the line in the digital sand. And every
 record label

I'm no lawyer, but if you're providing free advertising for something
I don't believe you'll get into any trouble unless you are:

a) using the copyrighted material to make fun of it;
b) using the copyrighted material to promote something the artist may
be against (eg. pornography, politics, etc.);
c) making money from using their copyrighted material.

I don't know about Rocketboom, but when I used copyrighted music on my
last show, I made a direct link to the Amazon page where you can
purchase the CD. Since they get free advertising as well as a link to
sell more albums, I doubt that they will ever complain.

The good thing about doing this is that you can sign up with Amazon
Associates and if anyone buys the product you can make 5% of the
profits. (My theory should work, but I haven't made a cent yet...)

In any case, the Clerks 2 web site is set up as a videoblog, so why
would Rocketboom get into any trouble... it seems to me that Kevin
Smith just wanted to generate buzz (and that's exactly what Rocketboom
contributed to). Besides, I bet you five bucks that Kevin Smith is a
Rocketboom fan... Amanda Congdon is too cute to evade his radar.

Oh wait... I've made 87 cents from Amazon Associates, yay.

Well, if you direct your audience from your vlog to go to
LeanBackVids.com then I don't think you should be at fault for people
watching in iTunes. Besides, I wonder if there's some way of
disclaiming the music you use by saying it was taken from a shared
music source... with all the legal jargon rolling around, there must
be a way to get out of that kind of lawsuit.

I would worry more if you do have a sponsorship. It would be a
responsible move to make sure that you are using music that you are
authorized to use. I have no doubt that as the web grows more
communial, it will not be as difficult to use a piece of music in
vlogs. My best advice is to play it safe for now by either adding a
disclaimer or linking to the product... the other option is to make
friends with record executives...

BTW, the only reason Kitkast took on a 1930s Hollywood theme is
because I was trying to find music that was open source! Alot of
these old movies and songs are open source so I got a lot of stuff off
archive.org to use for my intro/outro!

I realize that using copyrighted music is 100% illegal, but wonder if
there is a bigger risk of getting busted if the site contains

This is probably a worthless topic since any way you look at it is

Kitka, you seem to contradict yourself:

I don't believe you'll get into any trouble unless you are making
money
 from using their copyrighted material.

and then you go on to say that you might be making money via sales from
Amazon. Isn't this making money from using their copyrighted material?

 Pete

Good point, Pete, but the difference is quite clear; while I'm making
a few cents off the sale of their album, I'm not making any money by
using the music on my vlog... the money is made by using a perfectly
legitimate advertising service on my blog site.

So, when I said I've made 87 cents, the money was made from the text
link on my blog site, not by embedding the link somehow into my vlog
(which is probably do-able since I think Rocketboom does that with
their story links).

If a record exec has a problem with the money I make from Amazon
Affiliates, they can go ahead and sue Amazon. Seriously, though... a
begger makes more money on the street than I do from Amazon.

recommend that all videobloggers get educated on how rights

 you.

What hasn't been mentioned this time around, is why copyrights exist,
 apart from the money.

Don't assume that by using a work, you are promoting or advertising
that work. Copyright is not about making money, it is about retaining
control over your work, and having the legal right to make decisions
on where and how your work is used.

What one person thinks is a promotion of a work, the original artist

through the fair use provisions of the copyright act, which was
created to allow educational, parody or reference (news reporting for
 example) use.

Copyrights protect our culture, and they do that by allowing artists
to take control of their work. This also allows them to charge money
for the use of their work, in effect sponsoring them to create even
more work, and subsequently progressing our culture even further.

Unfortunately however, the system has become abused [RIAA/MPAA rant
here], but people like Lawrence Lessig and Creative Commons are
trying to fix it. You should also visit their site, and read about
what they're trying to do to protect culture and your rights.

Rights are good for you. My videoblog works are all Creative Commons,
attribution non-commercial sharealike. I have the right to allow you
to do whetever you like with my stuff, so long as you credit me as
the creator, share your works with the same allowances, and don't
make money off using it. I like having that right.

Well said, Richard. Some people were starting to act like anal jerks
about this topic earlier. Glad you set us all straight without
nitpicking.

[videoblogging] Re: Sponsorships?

2006-01-18 Thread Ms. Kitka
We are talking about CPMs that are much higher, $50 to $150.

Does the agreed price then depend on the subscription numbers or
average downloads? The two numbers differ greatly for my own vlog as
I'm sure it does with more popular vlogs like RB.

This just isn't true. There are many times when you can use material
that is owned by others without their permission. I can do a story
about Home Depot, for example, use their logo, film in front of their
store and talk all about them without their permission. Maybe I'm
uncovering bad practices, and of course they might want to stop me,
but
they can't. I can create a piece about Bush, using footage of Bush,

It's called FAIR USE, and there are many many times people can use

[videoblogging] Advice on microphones (for loud conventions)

2006-01-17 Thread Ms. Kitka
This weekend I posted my first footage from a correspondent attending
a convention and I'm wondering if anyone has any suggestions for good
quality microphones that would cut out as much background noise as
possible without muffling the interviewer/interviewee's voices.

This week's show containing convention interview footage can be found
here: http://libsyn.com/media/mskitka/Kitkast-01-12.mov

2006-01-12 Thread Ms. Kitka
Does any one have all that are in the subject line and have problems
with Firefox crashing when opening a video encoded with H.264?

I'm not sure how RB is encoded, but my Firefox crashes everytime I try
to play it in that window. I have to switch to IE just to watch it
which seems a little silly since I know they strongly support FF!

[videoblogging] Re: CES/Tradeshows and Access

2006-01-12 Thread Ms. Kitka
I got my Kitkast field correspondent Parker into the AVN Adult
Entertainment Expo last weekend and I was told that I must make sure
he had official press credentials. When I mentioned it was a
video-podcast he said that they don't admit a lot of bloggers/vloggers
and that I would have to prepare a professional-quality package with
the following items:

- Letter from Kitkast to confirm that Parker was a field correspondent;
- A description of the show (printed from web was fine);
- Printed shownotes;
- Business card;
- Video footage of the show (Parker supplied this on his video iPod).

When Parker registered he said he had no problem getting in and that
the registration desk even complimented him on how professional the
package was.

The best thing for you to do is get in contact with the media
registration before you fly out to wherever the conference is... and
make sure that they will allow professional quality videoblog media.
Besides, there might be something specific that they will require for
you to get in. Communication is key.

Go and have a great time!

A question for those vlogging at the CES.

Did you just turn up and do it, or is it better to go for press

be put on video - on the one hand it could be good publicity, on the
other you could be a competitor.

On a broader note, has anyone experience of the difference between a
public show like the CES and closed trade only shows.

I'm looking for stories - I haven't done it myself yet, but might
consider doing a vid of a tradeshow I am at next month.

[videoblogging] Re: Looking for any videoblogs that are a higher resolution

2006-01-12 Thread Ms. Kitka
I WISH I could post my show at that resolution, but it would take a
lot of storage space and you'd definitely need unlimited bandwidth. I
think that once space is cheaper and everything is faster it will
become a standard to broadcast on the Internet using widescreen HD
tv-sizes. I hope that someday I will get all my subscribed shows sent
directly to the screen implanted into my digi-wall. (Sure, I may be
living in a Star Trek fantasy, but I swear that it will happen someday!).

I look forward to seeing this in the future...

I know this stuff isnt the norm and has disadvantages, so I dont

[videoblogging] Re: PORN, yes, I said it PORN.

2006-01-10 Thread Ms. Kitka
There are several feeds that have been flagged as potential adult
content, not just the one, there are 25 of them. But I agree that
there should be some dialog with the producers of the feeds before
they get flagged, that's where Mefeedia did go wrong, agreed. The
process is being refined. It's not the content of the video that I
feel needs to be indentified, it's the thumbnails.

 --
 ~Devlon

I wish that there were more options when submitting a feed to a site
like Mefeedia. Many sites ask whether your vlog is explicit or
contains adult content but that's where I believe they're wrong.

What would be nice is if the sites would provide markers indicating
the rating level of content similar to Hollywood films (G, PG-13,
PG-16, R, X). There's nothing I hate more than sitting in front of
the computer wondering whether I should label myself as adult or for
everyone. When submitting a feed, there should be a drop down list of
options similar to the ratings listed above. Those ratings should
then show up as a label when people are browsing through the vlogs.

Until there is some way to completely block over-18 content from
children, I believe this is a good way to rate things. I wonder if
there is some way to make people registering for an account to enter
their birthday and to program the site to allow content only within
their age group. If they accept your terms and conditions saying they
have given their true age and information, the company providing the
content would not be at fault if a child registers as an adult.

[videoblogging] Re: PORN, yes, I said it PORN.

2006-01-10 Thread Ms. Kitka
Ratings could be something like: Kids/General/Mature/Adult

Sorry, but I don't think either of these tags fit all content very
well. I think we'd need something like PG-13 or PG-16. I just think
that David's description of Mature and Adult are too similar, which is
why I mentioned R and X (R is violence/nudity, X is porn). Neither
apply to Kitkast, which is why I suggested something like PG-13 and
PG-16... it contains sexual themes, not graphics.
