Re: [Wikimediach-l] Drone and insurance

Hi Clément,

This should answer your legal question :

admin.ch : « Haltereigenschaft(en) nach SVG » / « Qualité(s) de détenteur
selon la LCR »

https://www.regress.admin.ch/fileadmin/redaktion/Dienstleistungen/Ausbildung/d/Bt_Haltereigenschaften_nach_SVG_d_2013.pdf
https://www.regress.admin.ch/fileadmin/redaktion/Dienstleistungen/Ausbildung/f/Bt_Haltereigenschaften_nach_SVG_f_2013.pdf

I agree with your view that you should clarify the situation and your
respective roles with WMCH before using the drone.

In my interpretation, if WMCH reserves for itself the right to decide who is
allowed to use or steer the drone, if it is up to WMCH to decide whether the
drone is in an appropriate state to be used, and if WMCH pays for the
exploitation cost, they would be considered the Halter / détenteur. If the
association delegates this role to you, you would be the Halter / détenteur,
independently from the fact that the association is the owner of the drone
(most likely even if the association is re-funding the exploitation cost).

Probably it would be wise to have a written agreement with the insurance
company that the association is to be considered the Halter / détenteur
whenever the drone is being used by en employee or a member of the association,
and to have an agreement between the association and the users of the drone
regarding the conditions of use (e.g. users have to prove that they are able to
steer it; the use is only allowed in the interest of association goals).

Disclaimer: I'm not a lawyer. So take this information and advice at your own
risk.

Cheers,
Beat

Subject: [Wikimediach-l] Drone and insurance

Hello all,

Short abstract:

The association has a drone, currently in Geneva. The swiss legislation is
permissive, but one must have an insurance to use it. As the drone is WMCH's
property, who should get the required insurance ? More generally, what about
insurance for equipment and volunteers ?

Long version:
In light of the actuality in France, where a young boy have been prosecuted for
filming with a drone (in French:
http://www.lemonde.fr/societe/article/2014/02/14/un-lyceen-poursuivi-pour-avoir-filme-nancy-a-l-aide-d-un-drone_4366386_3224.html
), may I remind you that the association is the proud owner of a DJI Phantom
(https://commons.wikimedia.org/wiki/File:WMCH_Drone.jpg), a drone that can be
used in combination with a GoPro to take pictures. Examples are here:
https://commons.wikimedia.org/wiki/Category:Media_supported_by_Wikimedia_CH_-_Drone

The swiss legislation is by far more permissive than the French one when it
comes to drones. An abstract is avalaible here:
http://www.bazl.admin.ch/dienstleistungen/02658/index.html

My
question is: Who is the exploitant/Halter ? Is it the association or is it
the person piloting the drone ?

* Can the association have a formal and legal advice on this ?

* Can the association get an insurance for the volunteers piloting the drone ?

This also raise the question of insurance for the equipment owned by the
association, and for the volunteers and their equipment while participating in
events for the association.

* If one causes damage with the association equipment, or if the association
equipment is damaged or stolen, how are we insured ?

* If my equipment is damaged or stolen while participating to an event for the
association ?

I think those are important questions, that need a real answer.

Just for information, I will not fly the WMCH drone until the situation is
clear, as I think this is to jeopardizing for me.

Hi everyone!

I posted the latest in the string of program evaluation reports on Meta today,
on GLAM content donations:
https://meta.wikimedia.org/wiki/Programs:Evaluation_portal/Library/GLAM_content_donations

Highlights of the report include:
* Program leaders who engage in activities that lead to GLAM content donations
have five priority goals
* On average, GLAM content donations have four people involved and take an
average of three months to implement from beginning to end
* Only a small portion of the donated media have been used in Wikimedia project
pages
* Program leaders who implement programmatic activities that lead to GLAM
content donations are experienced, and produce documentation and blogs about
their implementations
* And more! Read the report to find out:
https://meta.wikimedia.org/wiki/Programs:Evaluation_portal/Library/GLAM_content_donations

We'll be discussing this report and other reports during a Hangout tomorrow
(Thursday) at 6 pm UTC. You're welcome to join us:

Hi Charles,

You can roughly calculate the workload based on the duration of the talk
multiplied with a factor between 3 and 8.

There are several factors that influence the workload:
- Speed of the talk (i.e. number of words per minute)
- Clarity of the talk
- Degree of specialization / specialized terminology
- Experience of the person doing the transcription
- Technical equipment
- Output quality

Kind regards,
Beat

J.

NEW PARTNERSHIP TO MAP THE PUBLIC DOMAIN IN FRANCE

Last night Aurélie
Filippettihttp://en.wikipedia.org/wiki/Aur%C3%A9lie_Filippetti, the French
Minister for Culture and Communication, announced a new partnership between the
French ministry of Culture and
Communicationhttp://www.culturecommunication.gouv.fr/ and the Open Knowledge
Foundation Francehttp://fr.okfn.org/ to take steps towards mapping the public
domain in
Francehttp://cblog.culture.fr/projet/2013/11/08/un-calculateur-du-domaine-public-francais.

The 'public domain calculator'http://publicdomain.okfn.org/calculators/
demonstrator project will develop a tool to help establish legal status of
cultural works - in particular helping users to determine whether or not they
have passed out of copyright and into the public domain. You can watch a video
about the partnership herehttp://vimeo.com/78740619 (in French, with English
translation coming soon).

In her
speechhttp://www.culturecommunication.gouv.fr/Espace-Presse/Discours/Discours-d-Aurelie-Filippetti-ministre-de-la-Culture-et-de-la-Communication-prononce-lors-de-la-ceremonie-de-cloture-de-la-journee-d-echanges-Transmettre-la-culture-a-l-ere-du-numerique-et-de-remise-des-prix-de-l-Automne-numerique,
 Minister Filippetti said:

We often say that a work has fallen into the public domain, as though it
falls into a state of disuse, abandonment or oblivion. In fact, precisely the
opposite is true. When a work enters the public domain, it experiences a
rebirth. And I want to show that my department recognises this. Therefore, to
support our thinking in this area, we have formed a partnership with Open
Knowledge Foundation France to develop a prototype of a French public domain
calculator using a set of cultural metadata (in this case a selection of
metadata about works from the Great War) provided by the National Library of
France.
[cid:~WRD000.jpg]
French Minister for Culture and Communication Aurélie Filippetti announcing the
partnership between the ministry and Open Knowledge Foundation France.

The announcement was made at a reception at the end of an event on 'the
transmission of culture in the digital
age'http://cblog.culture.fr/2013/10/15/journee-dechanges-du-7-novembre-transmettre-la-culture-a-lere-du-numerique,
which included talks about the value and potential of the digital public
domain and open data from cultural institutions.

I gave a keynote talk about the Open Knowledge Foundation's work on mapping the
cultural commons with the public domain
calculatorshttp://publicdomain.okfn.org/calculators/, as well as other
related initiatives such asOpenGLAMhttp://openglam.org/ and The Public Domain
Reviewhttp://publicdomainreview.org/.

Results were presented from a recent 'mashup
workshop'http://www.dailymotion.com/video/x16xany_automne-numerique-retour-sur-le-mashup_news#from=embediframe
to encourage creative reuse of public domain works, run by the ministry in
partnership with Open Knowledge Foundation
Francehttp://blog.okfn.org/2013/11/08/new-partnership-to-map-the-public-domain-in-france/fr.okfn.org,
 Wikimedia Francehttp://www.wikimedia.fr/ and others.

There were also talks from the Rijksmuseumhttps://www.rijksmuseum.nl/en and
the British Libraryhttp://www.bl.uk/ about what they are doing to publish and
encourage the reuse of open data and open digital copies of public domain works.

Overall the day made clear that the Digital Policy Department at the French
ministry of Culture and Communication, under the leadership of Camille Domange,
have taken the decision to put the digital commons high up on their agenda.

It is very encouraging to see such strong government recognition of the value
of the public domain as an indispensable public good. We applaud France's
leadership in this area, and hope this will inspire other countries to do more
to enable the digital public domain to flourish and to take steps to support
its reuse for the benefit of citizens - whether for education, creativity, or
enjoyment.

If you're interested in helping to establish a vibrant and open digital public
domain in your country, please come and introduce yourself on our Public Domain
Working Grouphttp://lists.okfn.org/mailman/listinfo/pd-discuss.

Subject: [Wikimediach-l] Wikimedia CH has just hired two new directors

Dear all,

I'm very glad to tell you that Wikimedia CH has just hired two new directors.
Duc-Ahn Chung will be our new Chief Administrative Officer, starting in
November, and Charles Andrès, our former president of the board, will be our
new Chief Science Officer. Read on for more details!

When Chantal Ebongué, our CAO and first employee, told us she was planning to
leave, we set a recruiting committee to replace her. One of the reasons she was
leaving was that it was difficult to take care of both administrative work and
project work -- both because of the high workload, and because these two tasks
require very different competences. Thus, while drafting the job description,
the recruiting committee proposed to the board to hire two people. This was
accepted, and we now have filled these positions.

Duc-Anh (Anh) Chung, our new CAO, originally studied hotel management, and
worked as project manager in different hotels around the world. She then worked
as an executive assistant in a start-up company in Geneva, in charge of all
administrative matters. Since May 2012, she is assistant director in a large
non-profit organization in Geneva. In this position, she is responsible for all
administrative matters, and has a wide experience helping a purely volunteer
organization transform itself into a professional structure.

Among other tasks, Ahn will be in charge of the human resources and the
finances of our association, including the annual fundraiser and the financial
side of the FDC application, and will report directly to the board. She will
start working for Wikimedia CH on 1 November -- just in time for the fundraiser
:-)

Charles Andrès, our new CSO, was originally trained as a biologist; he received
a Master in Genetics followed by a PhD in Cellular Biology in France. Since
2007, he has worked as a senior scientist at the University of Neuchâtel, where
he is a researcher and lecturer in biology. He is a Wikipedian since 2007,
board member of Wikimedia CH since 2010 and the chairman of the board since
June 2012.

Charles will be responsible for all the projects conducted inside our
association, including both support of individual initiatives (members
projects) and institutional partnerships, and will be responsible for the
annual FDC application. Among other projects, he will oversee our GLAM
activities, as well as the development of our education program. He will report
directly to the board. Charles has started working part-time as CSO on 1
September (just in time for the preparation of the FDC application :-), and
will join us full time in early October.

The choice of a Chief Science Officer (CSO) position

The decision to create a CSO position stems from the fact that many of our
efforts (current and planned) are focused on scientific projects; by this we
mean not only that we have established many collaborations with academic
institutions, but also that we intend to drive our projects using a scientific
approach, as a tool to improve quality. We have received very good feedback on
this from many people in the Wikimedia community.

--
The choice of two directors rather than one executive director

In our current structure and given our level of development, the board still
takes care of many tasks traditionally in the hands of an executive director.
The choice of hiring two directors, each with well-defined areas of
competences, working closely together and with the board, was deemed the best
solution (note that despite the title of directors, they will not simply
delegate the day-to-day work to other employees, but will actually perform most
of it).

This solution fits well with the Swiss culture, as even the Federal government
is organized following such a collegial structure
(https://en.wikipedia.org/wiki/Federal_Council_%28Switzerland%29 ).

We are also glad to have been able to make a balanced hiring: not only have we
hired one man and one woman, but we have one director who knows the Wikimedia
movement very well, and another one who will bring a fresh pair of eyes.
Unfortunately, we have not been able to find a balance between the different
languages spoken in Switzerland, as we hired two native French speakers, but we
have made sure that our staff can cover adequately the different language
communities in the country.

[Wikimediach-l] Meeting with Fed. Office for Civil Protection - Section Cultural Property Protection

2013-05-24 Diskussionsfäden Estermann Beat
Dear all,

Yesterday, I have met with the people responsible for the protection of
cultural properties at the Federal Office for Civil Protection in Switzerland.
The minutes (in German) can be found here:
http://de.wikipedia.org/wiki/Wikipedia:WikiProjekt_Schweizer_Denkmallisten/Meeting_mit_dem_FB_KGS_vom_23._Mai_2013

Here a summary:

- They are happy to help us with the monuments lists in their area of
competence (in addition to the lists of cultural properties of national and
regional significance which are handled at the national level, there are also
cantonal and municipal monuments lists which they are not responsible for).

- They are positive about Wiki Loves Monuments; the same is true for the
cantonal instances they are in contact with (monument protection services /
civil protection services).

- They promised to provide us with database dumps, including all the
KGS-identifiers (A- and B-objects; identifiers of B objects have been missing
so far) by the end of May / beginning of June.

- They will take measures to facilitate the updating of the lists on
Wikipedia in the future (clearly indicating changes on their lists; making
database dumps available).

- They ask us not to use the official white-blue cultural-property sign
for any other objects than KGS class A objects and not to use similar signs
either (in fact the use of the official sign is regulated by international law
and Swiss law) - This should be taken into account when designing the
interfaces of information systems (map applications, phone apps, etc.)

- They gave us recommendations in order to avoid complications due to the
different semantic systems at various federal levels

- They will be happy to get informed about any corrections made by the
community.

So, and now I hope that the 26+ cantonal and municipal authorities responsible
for the rest of the monuments will be as cooperative as the federal ones! ;-)

Kind regards,
Beat Estermann

Dear Ilario,

I’m confident that the person moderating tomorrow’s GA, will abide by the
Bylaws and have the members vote about whether the motions should be included
in the agenda or not (see point 8.3 of the Bylaws).

So, I guess you shouldn’t worry; we will all know at the beginning of the GA.

Hi all,

Just as my work at the British Library is coming to an end, I'm delighted to be
able to tell people about a new Wikimedian in Residence post at the National
Library of Scotland - I've helped work to set this up, and I think there's a
real potential for doing amazing things here. The NLS is a great institution,
with some really innovative and forward-thinking work, and as well as the
obvious strengths in Scottish history and culture they have major map
collections and one of the most interesting publishing archives in the UK. Lots
of scope for interesting projects here.

It's full-time, for four months, though this may possibly be negotiable to a
longer period at part time - it's worth asking. The job is paid and formally
employed by the Library, funded jointly by the Library and by Wikimedia UK.
http://blog.wikimedia.org.uk/2013/04/1533/ has further details and a link to
the NLS recruitment site.

Please circulate this widely!

Thanks,

to be the most critical one. I am ready to assume the overall
coordination of the Swiss contest if there are enough other volunteers to
support me. I won't have the time to carry it through virtually on my own, as

[Wikimediach-l] Promotion of Wiki Loves Monuments @ seniorweb.ch

2012-09-03 Diskussionsfäden Estermann Beat
Dear all,

As last year, the Wiki Loves Monuments photo contest is again promoted by the
seniors online community seniorweb.ch:

http://www.seniorweb.ch/type/blog/2012-09-02-wiki-loves-monuments-2012-es-geht-wieder-los-0

Following the announcement, one of the last year's participants
askedhttp://www.seniorweb.ch/type/forum-topic/2011-06-24-tolle-aufnahmen-von-historischen-gebaeuden-und-monumenten-2011-und-2012?page=2#comment-252100
whether there is a contact person for interested photographers.
I guess what would be appreciated most is someone who could introduce them into
the workings of the Wikimedia Commons and Wikipedia communities. I guess, the
introduction/assistance could partly take place online in the Seniorweb forum.
On top of that it might make sense to organize also an introductory workshop
for interested people.

Is anybody interested in jumping on this occasion to reach out to older
contributors? - The last year's participant asking the question as well as
another interested colleague have already made their first steps on the wiki
last year and are experienced photo workshop moderators themselves - I guess
some sort of cooperation would be worthwhile as the two might act as
multiplicators within their community in the future.

Just drop me a line if you are interested.

Best regards,
Beat Estermann

Dear all,

Would it make sense to set up the workshops as kick-off meetings of working
groups which will meet in RL or online at several times over the coming months
and then report back to the Board/the Members? - Some issues might be too broad
to be dealt with during one afternoon and will need follow-up and active

My 2 cents

It means that this experience can be shared in order to apply it in
  biggest areas.

But the question of transparency and accountability is more focused
with the last proposed workshop because this is also a request of WMF
in order to improve the quality.

I mean transparency in general, for example related to the Project
 management:
 * who does what?
 * what are the current projects?
 * who is working on a project? what is the timeline?
 * ...

But also, you are right, accountability:
 * What are the activities of the board?
 * Where is the list of the board decisions?
 * Which votes are coming to the board?
 ...

Topic for this workshop is really broad... we won't be able to speak about
everything, but I do not want to (pre)ignore one point if attendees want
 to speak about that.

Re: [Wikimediach-l] Activities

2011-04-07 Diskussionsfäden Estermann Beat
Dear Frédéric, dear all,

There are some photography cracks among Seniorweb volunteers. We also discussed
about scanning old dias and photos today at a get-together of Seniorweb
volunteers. I think spreading the word in the Seniorweb community could be
worthwhile.

Is there someone who could give an introductory course in German? (e.g. in Bern)
- Legal aspects: Why is it important to publish the pictures under a free
license? Which licenses are acceptable for Wikimedia-related projects?
- Technical aspects: How to upload the photos?
- Community: What should they know about the community and the interactions on
the platform? Netiquette, core values?
- Content: Which objects would be particularly interesting for Wikipedia?
- Administrative: How do I get accreditations for events, etc.

Best,
Beat

  - A number of events in Zurich that I've seen advertised in post

As a reminder, Wikimedia CH is ready to help potential photographers who
would like to try to get accreditations for these (or other) events.
These can include for example providing photographers with an actual
affiliation (with supporting documentation if required), as well as
letters of reference (indicating why getting good pictures on
Wikipedia/Wikimedia Commons is a good idea, both for us and for the
 organizers of the events).

The only constraints is that it requires coordination (so that no two
photographers try independently to get an accreditation in the name of
Wikimedia CH for the same event).

In english below

internehttp://www.seniorweb.ch/fr/category/sw-editorial/freie-fahrt-ins-internett

internehttp://www.seniorweb.ch/fr/category/sw-editorial/freie-fahrt-ins-internett

Merci d'avance!

Re: [Wikimediach-l] [Executive] Web site, proposals

2011-03-12 Diskussionsfäden Estermann Beat
Dear all,

I would like to add a few things to the discussion, mostly based on our current
experiences with the launch of the TAO project website
(http://www.thirdageonline.eu/), for which many requirements were the same as
for the future Wikimedia CH website.

1) I can confirm that the cooperation with Sehsinn (Sami Kaddoura) has been
very positive and straightforward. There are a few basic things, like the main
structure, the multilingual functioning, and the identification of static vs.
dynamic contents of the site that take quite some time to be sorted out at
the beginning, before the site design can start. It may be possible to speed up
the process if you take the TAO project website as a reference from where to
define the requirements for the Wikimedia CH site (working with the same web
designer would help in this case).

2) Choice of the CMS: Compared to the TAO website, there seems to be one big
difference concerning the requirements for the wikimedia.ch CMS - the future
contributors of the Wikimedia CH website are already familiar with MediaWiki,
which is not necessariliy the case for TAO, and the ease of copying content
from an internal Wiki to the public website may be a strong argument in favor
of MediaWiki. In case someone wants to get a feel of Wordpress, I can offer you
an account on the TAO-Website and, depending on your availability, I could also
provide you with some real tasks, which is probably the best way to get to
know a CMS.

3) Interactivity: One aspect I am missing on your requirements list is the
degree of interactivity you want for your site - do you want to get feedback to
your posts and allow for n:n communication (blog with the possibility of
posting comments or discussion forum)? In developping the TAO website, we
decided not to allow for interaction in a first step (but to leave the
possibility open in the future, which would not be very costly from a
development point of view). There are several reasons for this decision: (1)
From our point of view, interaction about TAO activities should first and
foremost take place on the community partners' platforms - we do not want to
create an additional community platform; (2) Allowing for interactivity means
more work: you need to be ready to police contributions in order to fight
SPAM or disruptive behaviour, and you need to have people and time to actively
participate in the interaction; (3) In the start version of the website, we
have translated some of the blog posts, meaning that you would expect a
discussion about a post to take place on several language versions in parallel
- this does not make much sense. (4) In order to avoid some of the
aforementioned problems, we have set up a Facebook group for the project
(discussions are presently going on about transforming it into a Facebook page
instead). On Facebook, several languages could coexist in one setting, and
policing for SPAM and disruptive behavior would probably be less of an issue,
as it does not happen on the official Website. On the other hand, it allows
for an open feedback culture with n:n communication (which I think would be
valuable); if we can get this going on Facebook, there may be no need to have
any interactivity on the project Website itself.

4) On the content side, I would also expect a description of concrete
possibilities for participation in the association's activities. It might be
helpful to show the visitors in which areas the various working groups need a
hand and which are the additional competencies required.

Best,
Beat Estermann

Dear all,

today I approach you in my position as CIO of Wikimedia CH. In the past
we had several discussions about a relaunch of the current website.

We have asked for input on content / features as well as ideas for a
swiss design:
* http://www.wikimedia.ch/Site_web
* http://www.wikimedia.ch/Website_2011

The list of features more or less is equal with that what the webteam
has came up with in 2008 and that has been implemented in the current
website. On the other hand we all agree that the current website needs a
graphical relaunch - at the moment it doesn't have any graphical concept
and neither Wikimedia CH in general has.

Ludovic and I have collected proposals for the relaunch. After a
analysis of what we have received I have compiled a list and ask you for
feedback:
* http://www.wikimedia.ch/Website_2011#Evaluation_of_Offers

As announced by our president, the website topic will be on the agenda
at the General Assembly on April 30th

Thanks for your attention and input,

Dear Manuel, dear list members,

Thank you, Manuel, for your encouraging e-mail! As I suggested in my previous
mail to you, we will have a look bilaterally at how you can get implicated in
the elaboration of the project proposal.

I agree with you that we first of all need grassroot support for the project
and I am very grateful that you mentioned that point. On the other hand, in
order to include Wikimeida CH in the proposal and to receive funding both on
behalf of Wikimedia CH and for the research institutions participating in the
project, it is important to get the association's official committment. It
therefore IS a question of the board.

Best regards,

Beat Estermann

Dear Beat, hallo Beat,

I really like your project and will support that.
In the german Wikipedia there is a similar project Generation 50plus:
http://de.wikipedia.org/wiki/Wikipedia:Generation_50plus

With a partner like the University of Berne I am pretty sure that this is a
very good idea. I hope other members will help.

I don't think that it is a question of the board. If members are willing - I am
- we can realise that.

Thanks for your offer,
