You can always "try" anything when you go to defend yourself.  CT used to
have (may still have) a policy whereby you could make a $50 donation to the
charity of your choice and your ticket was put on file or thrown out.  I
tried that in NH and the judge could not see a way (or his way) to do it.
But being creative does pan out, so try it or something.

I don't know the policy in VA, but here in NH, the arresting officer is
required to be present when you fight the ticket.  The officer is often much
more maleable and pleasant at the courthouse.  I had an officier that was
rude and strict when he stopped me, but pleasant and negotiable just prior
to the court hearing.  Needless to say, the ticket ended up being put on
file.

Attorney's can sometimes work magic, but more likely than not, for a regular
speeding ticket, you can do at least as well alone.

P.S.  Put on file means the ticket is held at that courthouse, and
thereotically will never come up at any level, unless you get yourself in
trouble again at that same courthouse.

The donation to a charity still exists here. But it applies to minor stuff 
like "no left turn" (ask me how I know). :^) For speeding and other 
"similar" infractions, the prosecutor can/will reduce, but will not 
extinguish the charge(s).

I don't know about VA, but NY/NJ area you can try the following 'trick'....

If you have a conviction and a fine of say $100, make a $10 'donation' to the 
town/court and pay $110.

The town will then need to send you a check to ballance their books and more 
importantly, close out the file.

Frame the check, burn it, do anything but cash it.
this way the file never closes, and the insurance co. never learns of the 
points.

On record, you have paid the fine and don't get in trouble locally.

I don't know if this still works or will work where you are, but still HTH...

Again thanks to Kazuto and Andre as both were spot on with their diagnosis.

So today I picked up from my dealer said final stage unit and just finished
replacement.  A pretty easy job as long as you don't mind 'standing on your
head' for 15 minutes or so!
$79 - 10% CCA discount + tax at my local dealership available same day
(wonder why they stock these?)  ;-)

Plus I got to look over a V-12 7 series, Comp. package M3 and a new M
roadster while I was waiting for my parts as a bonus.

Problem solved, thanks again!

When the E36's display this behaviour it's invariably the temp senser (the
cast heat sinked gizmo) in under the center dash.

Sorry I meant final stage resistor fan controller. The heat sink is used to
keep it cool as a lot of current is dropped across the resistors.

Well after looking for the last several months for a decent 3 or 5 series, 
we were almost ready to give up.  The wife liked the Saab though, and quite 
honestly, you cant beat the prices of used ones.  We picked up an 04 9-5 ARC 
in excelent condition with 30k for $13500.  I dont particularly like the way 
that much power feels from that V6 turbo in a FWD.  Major torque steer.  But 
She loves it though, and that is what is important.

So either the Porsche or the BMW has to go, and I hate to say it, but the 
BMW is the one going.

So if anyone is interested, it is in Central Florida(Deland).  It is a 99 
328iC convertible.  The color is green.  I just put a brand new black top on 
it, brand new tires, brand new brakes and rotors, UUC short shifter, M3 
suspension and exhaust, clutch fan eliminated with the kit.  The oil has 
always been consistantly changed at around 5k every time with synthetic.  We 
just tuned it up with new plugs, air filter, fuel filter etc etc.  It runs 
and drives extremely nicely.

Now the bad.  The top is fully automatic, but usually needs help.  You dont 
actually have to get out of the car, but it stops in a couple places and 
needs a little nudge.  The left rear wheel bearing is making some noise on 
the highway.  The a/c blows ice cold at night and when it is raining, but in 
the heat of the day it is only cool.  Maybe freon?  The body is straight 
with no accidents, but has a few dings and scratches.  The interior is 
mediocre.  The rear seat bottom is ripped on the seams and the driver seat 
release does not work..  Both seats are power and work perfect though.

If anyone is interested or knows someone that is, we will let it go around 
$8000.  It currently has 99200 miles.  Mechanically maintained perfectly, 
but wife driven.  Paint is shiney and the car looks great when detailed, 
especially from 10 feet away.

I love the car, but it is not really my car.  The wife says to sell it.

Does anyone know where I can find the total # of 2001 M roadsters produced 
and/or sold in the US?

A pal thinks his is about to get stolen 'cause he saw some 1 in 200 statistic 
with the 2001 M roadster on the top of the list........gotta love statistics 
that create paranoia.  Now he wants an alarm for his car so in suburban Detroit 
he'll feel a little safer with his car in the garage.  ;-P

I figure the number is probably close to 1000-2000 cars for that model year, 
but perhaps I'm underestimating?

2001 MZ3's were pretty low production.  IIRC there were less than
1000 total M Coupes produced w/the S54 engine for 2001 & 2002
model years & probably a max of 3x as many.

there used to be someone who posted BMW internal sales volumes
to the Z3 roadster & coupe message boards on Roadfly, but I don't
have a link saved & Roadly seems to be offline at the moment.

if even 10 of them have been stolen the per population theft
stastics will be all out of wack.  short of the car being flat-bedded
away, I don't think there's an easy way to steal an EWS-equipped
car w/o some pretty serious technology, but perhaps I've mis-understood
how the system works.

NA S54 (LHD): 1,600 built from 02/2001 thru 05/2002

I saw the same statistics, the 01 M Roadster was listed as the number
1 car stolen as a percentage of those produced with a 1 in 200 theft
rate.  That equates to a total of 8 cars stolen out of the 1,600
produced.

Not looking for a scam.  It looks like I'm facing a $150 ticket.  There are a 
range of language tidbits in VA law that point to good driver points that build 
up over time, and my lawyer (still have his number) followed this process

I plead guilty
The case was continued for 90 days to allow me to filfull several conditions

- I paid court costs ($30)
- I completed a state approved Driver Improvement Program, and submit proof of 
completion to the court. ($50, IIRC)
- I was not convicted of another infraction in that time period.

Having met those criteria, the charges were dismissed.  The judge used this 
element of the code to dismiss my charges.  The only stipulation that I see in 
the code (subsequent paragraph is that this may *not* be used to dismiss or 
reduce charges against drivers with commercial licenses.

Code of VA Citation (Gotta love the Internet. At least I know where my Hefty VA 
taxes are going): 

§ 46.2-505. Court may direct defendant to attend driver improvement clinic.

A. Any circuit or general district court or juvenile court of the Commonwealth, 
or any federal court, charged with the duty of hearing traffic cases for 
offenses committed in violation of any law of the Commonwealth, or any valid 
local ordinance, or any federal law regulating the movement or operation of a 
motor vehicle, may require any person found guilty, or in the case of a 
juvenile found not innocent, of a violation of any state law, local ordinance, 
or federal law, to attend a driver improvement clinic. The attendance 
requirement may be in lieu of or in addition to the penalties prescribed by § 
46.2-113, the ordinance, or federal law. The court shall determine if a person 
is to receive safe driving points upon satisfactory completion of a driver 
improvement clinic conducted by the Department or by any business, 
organization, governmental entity or individual certified by the Department to 
provide driver improvement clinic instruction. In the absence of such 
notificatio!
 n, no safe driving points shall be awarded by the Department.

1.  Cruise control:  It is possible to reassemble your broken cruise control 
column switch, if you can find the very small ~2mm diameter ball bearing 
that is the sort of pivot/follower on the business end of the stalk.  But 
it's very tedious, and you are likely to say ok I'll go buy one.  Used to 
cost about $80 now over $100.  I bought another to be up and running and 
have put my original back together, using brush on capilary action model 
cement/solvent and secured it with one or two wire ties.  In fact I 
reinforced the new one with wire ties before putting it in.  The case with 
"melted tab" assembly just isn't strong enough to withstand a knee bump, or 
a brother in law who thinks it's a mechanical lever linked to the throttle 
body, the wire ties really do help.  No I won't give up my spare, too much 
time invested in it.

2.  I've got the new E46 fan control unit, but won't have the bentley book 
till next week.  Can someone point me to some instructions for where to find 
the thing?  I wasn't able to successfully search for the proceedure.
