I think the FAA is using the "was ever operated" clause to limit the
number of old AC that can get flow by sport pilots, in order to promote
the manufacture of new sport compliant aircraft by giving the
manufacturers and importers of new airplanes some protection.

Right or wrong, the FAA thinks this a necessary step to revitalize entry
level GA.
