This thread is now closed.  These personal
attacks on Mr. Thomas are uncalled for.  We insist on more professional
decorum.  Any more attacks like this one will result in a list suspension. 
Some of you read a lot more into Mr. Thomas’s post than I think he intended. 
This behaviior is ridiculous and uncalled for.  I suggest some apologies are
due.

Do you report people to the authorities for not wearing their seat 
belts?  How about for speeding?

Both of those can result in direct harm to people.  Filing or not filing 
form 477 will not directly harm anyone.  It might result in the non 
filer getting in trouble.  But that is HIS or HER problem.  Not yours.

It is not your place to enforce this on others.

If this mailing list becomes an enforcement tool for the government, I'm 
out of here 

P.S.  I have and will continue to file the 477.  I just have no use for 
nark's.

Could you provide a list of "illegal activities" that have been promoted
here?I've been watching this list since the day it started, and aside
from some humorous comments, I have never seen anyone promoting "illegal
activities".I tried to get WISPA members interested in lobbying the FCC
to stop doing this, but it seems they want regulation and taxation... so...
So be it.

I don't think WISPA should police WISPs. The organization does encourage 
conforming to FCC regs, and we've seen numerous postings from Marlon and 
others answering difficult rule interpretation. That's the best focus 
for our energies as a WISP organization - that is; making FCC links and 
docs available where needed, providing liaison between FCC and WISPs to 
accomodate WISPs customers needs... That's my stand.

that statement.

With all due respect I would like to ask that you not post suggestions 
that are blatantly against FCC regulations. In both of your messages I 
included below it appears you are advocating the complete disregarding 
of FCC regulations. I like to think of the WISPA list as a professional 
place to come and discuss fixed wireless technology. The last thing we 
want to do is give the appearance that we do not fully conform to all 
rules and regulations especially ones mandated by the FCC.

It was 400 wisps last I heard.

You HAVE to fill it out.  Doesn't do anything for you to not fill it out 
anyway.


On this note.  I spent quite a bit of time on the phone with the 477 folks 
today (we're working with them on a solution for those that don't have 
excel).


It turns out it's not unusual for third parties to file for you.  You just 
have to sign a form saying that the info from the other party is accurate. 
Many small telcos have consultants or lawyers do it for them.


Having said that, we'll send them in for anyone that doesn't want to take 
the time/can't figure it out/doesn't have the needed software.  I'll have my 
gals ding your cc for $25 to cover their time.


I think this is something that wispa could also do for folks.  Anyone want 
to volunteer their time for this?  I can help you figure out how to fill out 
the forms for others.  It'll take a bit the first time or two but after that 
it shouldn't be too hard.

I believe I heard a stat that 475 WISPs filled them out last time.  Pretty 
poor showing in my opinion with some sources saying there are approximately 
6000 WISPs in the US.  You do what you want.  As for me, I'm going to stay 
legal.  If the FCC monitors this listserv, who do you think they will 
concentrate their efforts on, those who follow their rules or those who snub 
them.  I am going to assume they will go after those who don't follow the 
rules first.  If you think you are invincible because they "don't know about 
you", Good Luck!

I think this clause of the Communications Act might be used for unlicensed
spectrum violations.

"If the violator is neither a broadcast station licensee or permittee, cable
television operator, or applicant for any broadcast or cable television
operator license, permit, certificate or other instrument of authorization
issued by the FCC, or a common carrier, the amount of the forfeiture penalty
can not exceed $10,000.00 for each violation or for each day of any
continuing violation, except that the amount assessed for any continuing
violation can not exceed a total of $75,000.00 for any single act or failure
to act constituting a violation."

Or is it?

"Certain sections of Part 1 of Title II contain specific penal provisions
for violations. For example, Section 219 of the Act requires annual reports
from communications carriers and their parent corporations, if any to file
annual reports with the FCC. The failure of a carrier to file an annual
report is subject to a fine of $1,200.00 for each and every day the carrier
fails to file the report. The $1,200.00 fine under Section 219 is separate
and distinct and not in addition to those prescribed under Sections 501 and
502 of the Act. Similarly, Sections 214, 220 and 223 have separate and
distinct forfeiture provisions, which are not cumulative to the forfeiture
provisions under Sections 501, 502 and 503 of the Act."

Either way, not to many WISPs could afford these penalties not to mention
attorneys fees, time and travel.

By no means am I attempting to dig this up again but there are 2 trains 
of thought that have been brought out on this list. One is to file and 
let the Commission know they exist and the other is to fly under the 
radar.  Some say letting the FCC  (and others) know they exist could 
bring positive or negative results. Flying under the radar (providing 
there are no penaltys) and not reporting is another option.

Giving up spectrum is not something that happens much anymore without an 
auction. Wisp numbers are not the only thing that will drive new 
unlicensed spectrum releases. Manufacturers lobbying, municipal systems, 
colleges and universities needs, scientific and research spectrum 
requirements for data.  These are all things that will drive unlicensed 
spectrum releases IMHO if and when they happen.

Nowback to my question.  What happens to the provider that doesn't 
file Anyone care to suggest/project/assume/state what the official 
punishment is?  I know what it is for the "others"  (LEC's , CLEC's, 
Cable Operators) but what about the unlicensed operator? 

And what about the local university that provides "broadband" for the 
student for free or at a reduced rate??  Do they need to file??

With all due respect I would like to ask that you not post suggestions 
that are blatantly against FCC regulations. In both of your messages I 
included below it appears you are advocating the complete disregarding 
of FCC regulations. I like to think of the WISPA list as a professional 
place to come and discuss fixed wireless technology. The last thing we 
want to do is give the appearance that we do not fully conform to all 
rules and regulations especially ones mandated by the FCC.

I believe I heard a stat that 475 WISPs
filled them out last time.  Pretty poor showing in my opinion with some
sources saying there are approximately 6000 WISPs in the US.  You
do what you want.  As for me, I’m going to stay legal.  If the
FCC monitors this listserv, who do you think they will concentrate their
efforts on, those who follow their rules or those who snub them.  I am
going to assume they will go after those who don’t follow the rules
first.  If you think you are invincible because they “don’t
know about you”, Good Luck!

8. Are Wireless Internet
Service Providers (WISPs) exempt?

No. Entities that provide broadband connections to end
user locations by using spectrum on an
unlicensed basis for the “last hop” to the end user
location must report information about those connections. Typically this is
done by completing the questions for broadband category 7 (“terrestrial
fixed wireless”) in Part I of the form and also filling in column (f) in
Part V of the form. (If broadband connections are reported in another
technology category, such as “terrestrial mobile wireless,” please
put a brief explanatory note into Part IV of the form.) A WISP should consider
the user data rate (as opposed to the over-the-air raw data rate, for example)
when determining whether connections are broadband for purposes of Form 477. (A
broadband connection enables the end user to receive information from and/or
send information to the Internet at information transfer rates exceeding 200
kbps in at least one direction. See also FAQ #5.)

A WISP should not
report subscribers to its broadband Internet-access service when that service
is delivered over a broadband connection to the end user location that the
WISP, or the WISP’s customer, has obtained from an unaffiliated entity
such as a municipality, public utility district, or DSL service provider
(“DSL wholesaler.”) The underlying, facilities-based providers of
wired broadband connections to end user locations are responsible for reporting
them, and any particular broadband connection should be reported only once in
this data collection. See also FAQ #10.

Part II and Part III of Form 477 – which are the
parts of the form where information about local telephone service is collected
– may not apply to particular WISPs:

Only WISPs that are authorized (by
the WISP’s state telecommunications regulator) to operate as a CLEC need
to consider Part II of the form, and they should also see FAQ #13.

·   
Only WISPs that offer mobile
telephone service as commercial mobile radio service (CMRS) providers need to
consider Part III of the form. Note that CMRS providers typically hold or
operate spectrum licenses for cellular, PCS, or SMR services.
