Sounds like the window lifter broke. In my case, the plastic that holds the cable ends in place broke. There's no easy way to fix the plastic holder, and the lifter is a complete unit, so you have to replace the entire part. Should cost around $75-$100 (I paid $75 with BMWCCA discount at local dealer). It is not a difficult repair, but you do have to take the door panel off in order to get to it. Took me maybe an hour total. The plastic sliders crack, and the arms pop out, causing the exact problem you describe. Hate to hear you are seeing the same problem in an E46. The rear end appears to kick out slightly to the right and you see the driver's left arm come up as he turns right to correct. Most certainly it 'could have' been replaced from being rusted. In my experience in the midwest, I've seen barely any E30's with panel replacement from rust (at least, the trunk, front fenders). These R-Dot panels are factory replacements. It could have also been a small parking lot accident or the like. Obviously, depending on how cautious a buyer you are, the only way to tell for certain is to have it inspected on a lift or jig to look for frame damage. IMO, just because an older BMW has a DOT panel definitely doesn't remove it from consideration of purchase. If the car is right and the price is right, mechanicals, etc...don't pass it up just because of this.
